BILL NUMBER:A8912 TITLE OF BILL: An act to amend the public health law, in relation to indoor air quality in ice skating rinks PURPOSE OR GENERAL IDEA OF BILL: This bill promotes public health by requiring Sanitary Code regulations for safe and appropriate operation, maintenance and monitoring of ice resurfacing equipment using internal combustion engines. SUMMARY OF SPECIFIC PROVISIONS: Bill §1 adds a new subdivision 13 of §225 of the Public Health Law, providing that the Public Health Council (PHC) shall amend the State Sanitary Code to ensure safe and appropriate indoor air quality in ice skating rinks. Specifically, the PSC shall establish regulations providing that all ice resurfacing equipment powered by combustible fuels which produce carbon monoxide, nitrogen dioxide and/or particulate matter shall be maintained and operated to ensure acceptable air quality. The regulations shall specify levels of air contaminants that would require: -notification to appropriate state and/or local officials; -implementation of remedial measures to protect public health; or -immediate evacuation of the rink.

GIANARIS -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to indoor air quality in ice skating rinks THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 225 of the public health law is amended by adding a new subdivision 13 to read as follows: 13. NOTWITHSTANDING THE PROVISIONS OF ANY GENERAL, SPECIAL OR LOCAL LAW TO THE CONTRARY, THE PUBLIC HEALTH COUNCIL SHALL ESTABLISH REGU- LATIONS PROVIDING THAT ALL ICE RESURFACING EQUIPMENT POWERED BY COMBUST- IBLE FUELS WHICH PRODUCE CARBON MONOXIDE, NITROGEN DIOXIDE AND/OR PARTI- CULATE MATTER SHALL BE MAINTAINED AND OPERATED IN A MANNER THAT ENSURES SAFE AND APPROPRIATE INDOOR AIR QUALITY IN ICE SKATING RINKS. SUCH REGU- LATIONS SHALL INCLUDE PROVISIONS WITH RESPECT TO: (A) SPECIFICATION OF LEVELS OF AIR CONTAMINANTS THAT, IF EQUALED OR EXCEEDED, SHALL REQUIRE (I) NOTIFICATION TO APPROPRIATE STATE AND/OR LOCAL OFFICIALS; (II) IMPLEMENTATION OF REMEDIAL MEASURES TO PROTECT PUBLIC HEALTH; OR (III) IMMEDIATE EVACUATION OF THE ICE SKATING RINK; (B) PROCEDURES FOR SAFE OPERATION AND MAINTENANCE OF ICE RESURFACING EQUIPMENT; (C) REQUIREMENTS FOR ADEQUATE VENTILATION; (D) REQUIREMENTS FOR EQUIPMENT AND PROCEDURES FOR SAMPLING AND MONITORING OF INDOOR AIR QUALITY IN INDOOR SKATING RINKS; AND (E) SUCH OTHER MATTERS AS MAY BE APPROPRIATE FOR THE SECURITY OF LIFE OR HEALTH. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, that the public health council and the department of health shall be immediately authorized and directed to promulgate any rules and regulations and take any other actions neces- sary for implementation of this act on such date.
