AN ACT to amend the public health law, in relation to indoor air quality
  in ice skating rinks

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 225 of the public health law is amended by adding a
new subdivision 13 to read as follows:
  13. NOTWITHSTANDING THE PROVISIONS OF ANY GENERAL,  SPECIAL  OR  LOCAL
LAW  TO  THE  CONTRARY,  THE PUBLIC HEALTH COUNCIL SHALL ESTABLISH REGU-
LATIONS PROVIDING THAT ALL ICE RESURFACING EQUIPMENT POWERED BY COMBUST-
IBLE FUELS WHICH PRODUCE CARBON MONOXIDE, NITROGEN DIOXIDE AND/OR PARTI-
CULATE MATTER SHALL BE MAINTAINED AND OPERATED IN A MANNER THAT  ENSURES
SAFE AND APPROPRIATE INDOOR AIR QUALITY IN ICE SKATING RINKS. SUCH REGU-
LATIONS  SHALL  INCLUDE PROVISIONS WITH RESPECT TO: (A) SPECIFICATION OF
LEVELS OF AIR CONTAMINANTS THAT, IF EQUALED OR EXCEEDED,  SHALL  REQUIRE
(I)  NOTIFICATION  TO  APPROPRIATE  STATE  AND/OR  LOCAL OFFICIALS; (II)
IMPLEMENTATION OF REMEDIAL MEASURES TO PROTECT PUBLIC HEALTH;  OR  (III)
IMMEDIATE  EVACUATION  OF  THE ICE SKATING RINK; (B) PROCEDURES FOR SAFE
OPERATION AND MAINTENANCE OF ICE RESURFACING EQUIPMENT; (C) REQUIREMENTS
FOR ADEQUATE VENTILATION; (D) REQUIREMENTS FOR EQUIPMENT AND  PROCEDURES
FOR  SAMPLING  AND  MONITORING  OF  INDOOR AIR QUALITY IN INDOOR SKATING
RINKS; AND (E) SUCH OTHER MATTERS AS MAY BE APPROPRIATE FOR THE SECURITY
OF LIFE OR HEALTH.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law; provided, that the public health council and
the department of health shall be immediately authorized and directed to
promulgate any rules and regulations and take any other  actions  neces-
sary for implementation of this act on such date.
