BILL NUMBER:A8980 TITLE OF BILL: An act authorizing the game of poker at the Belmont Park racetrack and one off-track betting simulcast facility per county PURPOSE: This bill authorizes the game of poker at the Belmont Park racetrack and one off track betting simulcast facilities per county SUMMARY OF PROVISIONS: Section 1- Defines the game of poker as a game of skill to be permitted at the Belmont Park racetrack and all off track betting simulcast facility not to exceed one per county Section 2- Contains effective date. JUSTIFICATION: This legislation would define poker, like the state of California has, as a game of skill and not considered gambling. It will be played in accordance with the house rules as established by an organ- ization authorized by the state racing and wagering board. It will also be approved by the state racing and wagering board. This legislation would also provide for poker to be played at certain facilities, creat- ing a new way to accumulate tax revenue and a taxable profit to be used were needed throughout the community. PRIOR LEGISLATIVE HISTORY: New legislation. FISCAL IMPLICATIONS: None.

ALESSI -- read once and referred to the Committee on Racing and Wagering AN ACT authorizing the game of poker at the Belmont Park racetrack and one off-track betting simulcast facility per county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Game of poker. 1. The game of poker shall be permitted at the Belmont Park racetrack and all off-track betting simulcast facili- ties not to exceed one per county. 2. For purposes of this act, the game of poker is a game of skill, played in accordance with the house rules as established by an organiza- tion authorized by the state racing and wagering board and approved by the state racing and wagering board and shall be defined as "texas holdem". 3. a. Where the poker game is contest style, there shall be an entry fee into each poker game where a percentage of such fee shall be retained by the racetrack or off-track betting simulcast facility with the remaining amount going into a pool for prizes. b. Where the poker game is free play, the racetrack or off-track betting simulcast facility shall keep a percentage of each hand with the remaining amount going to the winner. 4. The state racing and wagering board shall be the oversight board for poker wagering in the state. 5. All rules and regulations that apply to cashiers or tellers for racetracks and off-track betting simulcast facilities shall apply to all poker dealers. 6. The racetrack or off-track betting simulcast facility shall retain thirty percent of the amount collected or withheld from the game of poker, twenty percent shall go to the state and fifty percent shall be directed to the county in which the racetrack or off-track betting simulcast facility is located.
