BILL NUMBER:A9062 TITLE OF BILL: An act to amend the social services law, in relation to increasing state supplemental benefits to persons receiving enhanced residential care PURPOSE OR GENERAL IDEA OF BILL: The purpose is to continue to provide a cost of living adjustment (COLA) on the State supplemental benefit for persons receiving enhanced residential care (i.e., recipients in Congregate Care Level 3 facilities). SUMMARY OF SPECIFIC PROVISIONS: This legislation provides that the state payment portion of the monthly SSI benefits for persons receiving enhanced residential care be annually increased by a percentage which is the same as any federal SSI cost of living adjustment. EXISTING LAW: Existing law, which provides for such a COLA on the State supplemental benefit for persons receiving enhanced residential care, expires December 31, 2009. JUSTIFICATION: In 2006, legislation was enacted into law to provide for an annual COLA on the State supplemental benefit for persons receiving enhanced residential care (i.e., recipients in Congregate Care Level 3 facilities). WRIGHT -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to increasing state supplemental benefits to persons receiving enhanced residential care THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 2 of section 209 of the social services law, as added by section 4 of part U of chapter 57 of the laws of 2009, is amended to read as follows: (f) (I) The amounts set forth in paragraphs (a) through (e) of this subdivision shall be increased to reflect any increases in federal supplemental security income benefits for individuals or couples which become effective on or after January first, two thousand ten but prior to June thirtieth, two thousand ten. (II) IN ADDITION TO THE AMOUNTS SET FORTH IN SUBPARAGRAPH (I) OF THIS PARAGRAPH, ON AND AFTER JANUARY FIRST, TWO THOUSAND TEN, THE ADDITIONAL STATE PAYMENT PORTION OF THE AMOUNTS SET FORTH IN SUBPARAGRAPH (I) OF PARAGRAPH (E) OF THIS SUBDIVISION SHALL BE ANNUALLY INCREASED BY THE SAME PERCENTAGE OF ANY FEDERAL SUPPLEMENTAL SECURITY INCOME COST OF LIVING ADJUSTMENT WHICH BECOMES AVAILABLE ON OR AFTER JANUARY FIRST, BUT PRIOR TO JUNE THIRTIETH, OF EACH CALENDAR YEAR, ROUNDED TO THE NEAREST WHOLE DOLLAR. S 2. This act shall take effect on the same date as the reversion of paragraph (f) of subdivision 2 of section 209 of the social services law as provided in section 4 of part C of chapter 57 of the laws of 2006, as amended.
