AN ACT to authorize the New York state and local  employees'  retirement
  system  to  accept an application for accidental disability retirement
  benefits from Thomas Whalen

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any other provision of law, the application
for  accidental  disability retirement benefits of Thomas Whalen who was
employed by the County of Erie and a member of the New  York  state  and
local  employees'  retirement system shall be accepted for consideration
by the New York state and local employees' retirement system as if  such
application had been filed with such system in a timely manner.
  S  2.  The application referred to in section one of this act shall be
submitted on or before December 31, 2010.   The  improved  benefits  due
Thomas  Whalen  will  become  payable on the effective date of this act.
Nothing in this act shall be construed as entitling Thomas Whalen to any
improved benefits for any period of time prior to the effective date  of
this act.
  S  3.  All costs associated with this act shall be borne by the county
of Erie.
  S 4. This act shall take effect immediately.
  FISCAL NOTE.--This bill would entitle Thomas Whalen, a current retiree
who was employed by Erie County, to file an  application  for  an  acci-
dental  disability  retirement and have it accepted for consideration as
if it had been filed in a timely manner. The improved  benefit  will  be
payable on a prospective basis only.
  If  this bill is enacted and Mr. Whalen is granted an accidental disa-
bility retirement benefit, there will be an immediate past service  cost
of  approximately  $49,000 which would be borne by Erie County as a one-
time payment.
