BILL NUMBER:A9150 TITLE OF BILL: An act to amend the public authorities law, in relation to excluding Associations of Community Organizations for Reform Now (ACORN) from the "green jobs-green New York act of 2009" PURPOSE: Excludes the Association of Community Organizations for Reform Now (ACORN) from applying for or receiving funds from the "Green Jobs- Green New York Act of 2009." SUMMARY OF PROVISIONS: Amends Section 1, Subdivision 3 of Section 1891 of the public authorities law, to exclude the Association of Community Organization for Reform Now (ACORN) from applying and receiving funds from the "Green Jobs-Green New York Act of 2009. JUSTIFICATION: In light of the recent news reports that released several video tapes showing ACORN staffers assisting an undercover couple in setting up an illegal prostitution business, it is questionable whether this organization is working in a legal manner and should not be allowed to receive state funds under the Green Jobs-Green New York Act of 2009. In addition to providing assistance in setting up an illegal prostitu- tion business, ACORN staffers also instructed the couple how to skirt other federal laws such as human trafficking, mortgage fraud, tax evasion and how to avoid detection from law enforcement. BARCLAY -- read once and referred to the Commit- tee on Energy AN ACT to amend the public authorities law, in relation to excluding Associations of Community Organizations for Reform Now (ACORN) from the "green jobs-green New York act of 2009" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 1891 of the public authorities law, as added by a chapter of the laws of 2009 amending the public authorities law and other laws establishing the "green jobs-green New York act of 2009", as proposed in legislative bills numbers S. 5888 and A. 8901, is amended to read as follows: 3. "Constituency-based organization" means an organization incorpo- rated for the purpose of providing services or other assistance to economically or socially disadvantaged persons within a specified commu- nity, and which is supported by, or whose actions are directed by, members of the community in which it operates, BUT SHALL NOT INCLUDE THE ASSOCIATIONS OF COMMUNITY ORGANIZATIONS FOR REFORM NOW (ACORN). S 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2009 amending the public authorities law and other laws establishing the "green jobs-green New York act of 2009", as proposed in legislative bills numbers S. 5888 and A. 8901, takes effect.
