BILL NUMBER:A9172 TITLE OF BILL: An act to establish a moratorium on disbursement of state monies to the Association of Community Organizations for Reform Now or to any organization related thereto; and providing for the repeal of such provision upon the expiration thereof PURPOSE OR GENERAL IDEA OF BILL: To prohibit certain entities from receiving funding under the 2009-10 New York State budget. SUMMARY OF SPECIFIC PROVISIONS: Section details the legislative intent. Section 2 establishes the moratorium on all state monies appropriated by the laws of 2009 from going to ACORN or any related organizations pend- ing investigations by the attorney general and the state comptroller and the reports from those entities to the Governor and the Legislature. JUSTIFICATION: It is the goal of this legislation to prevent the misuse of the funds of the state due to corruption, abuse and fraud. Recently ACORN has been the focus of numerous scandals ranging from voter fraud to providing advice to individuals on how to break the law. In the wake of these scandals, the United States Senate has overwhelmingly voted to block Housing and Urban Development funding from being distributed to ACORN and the United States Census Bureau has severed ties with the organization. In addition, it has recently been revealed that a princi- pal in ACORN misappropriated about $1 million of ACORN funds. Legislative intent. The legislature hereby finds and declares that in light of recent events and allegations surrounding the Association of Community Organizations for Reform Now (ACORN), it is necessary to suspend all funding sources provided by the state to ACORN and conduct a full investigation into the operations and actions of the organization, and all of its affiliates and their employees. S 2. Notwithstanding any other provision of law to the contrary, there is hereby established a moratorium on all monies appropriated by the laws of 2009 made available to the Association of Community Organiza- tions for Reform Now (ACORN), or any state chapter of ACORN as regis- tered with the secretary of state, any organization that shares direc- tors, employees or independent contractors with ACORN, any organization that has a financial stake in ACORN, any organization whose finances, whether federally funded, donor funded or raised through organizational goods and services, are shared or controlled by ACORN, or employees of ACORN.
