FIELDS -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to recreational marine fishing licenses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 11-0702 of the environmental conservation law is amended by adding a new subdivision 5 to read as follows: 5. ANY INDIVIDUAL THAT PURCHASED A LIFETIME RECREATIONAL MARINE FISH- ING LICENSE OR LIFETIME COMBINATION FISHING AND RECREATIONAL MARINE FISHING LICENSE PURSUANT TO THE FORMER PARAGRAPHS G AND H OF SUBDIVISION ONE OF THIS SECTION AS ADDED BY SECTION TWO OF PART LL OF CHAPTER FIFTY-NINE OF THE LAWS OF TWO THOUSAND NINE, IS ENTITLED TO A REFUND FROM THE DEPARTMENT IN THE AMOUNT PAID FOR SUCH LICENSE. S 2. Subdivision 5 of section 13-0355 of the environmental conserva- tion law, as added by a chapter of the laws of 2009, amending the envi- ronmental conservation law relating to establishing a registration system for saltwater recreational fishing, as proposed in legislative bill number A. 9234, is amended to read as follows: 5. Fees. A. A fee for registering on the registry may not be estab- lished or levied. Notwithstanding any other provision of law, a person registering through an online or telephonic registration system may not be charged a fee for registering. B. ANY INDIVIDUAL THAT PURCHASED A RECREATIONAL MARINE FISHING LICENSE, A SEVEN-DAY RECREATIONAL MARINE FISHING LICENSE OR A ONE-DAY RECREATIONAL MARINE FISHING LICENSE PURSUANT TO THE FORMER SUBDIVISION FOUR OF THIS SECTION, AS ADDED BY SECTION SIX OF PART LL OF CHAPTER FIFTY-NINE OF THE LAWS OF TWO THOUSAND NINE, IS ENTITLED TO A REFUND FROM THE DEPARTMENT IN THE AMOUNT PAID FOR SUCH LICENSE. S 3. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2009, amending the environmental conservation law relating to establishing a registration system for saltwater recreational fishing, as proposed in legislative bill number A. 9234, takes effect.
