PARMENT -- read once and referred to the Commit- tee on Transportation AN ACT to amend the highway law, in relation to permitting two or more towns to jointly purchase highway equipment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 142 of the highway law is amended by adding a new subdivision 6 to read as follows: 6. A. TWO OR MORE CONTIGUOUS TOWNS MAY, UPON THE REQUEST OF THE HIGH- WAY SUPERINTENDENTS OF SUCH TOWNS AND BY A MAJORITY VOTE OF EACH OF THE TOWN BOARDS OF SUCH TWO OR MORE CONTIGUOUS TOWNS AUTHORIZE THE HIGHWAY SUPERINTENDENTS OF SUCH TOWNS TO PURCHASE AND PROVIDE FOR STORAGE OF HIGHWAY EQUIPMENT AS PROVIDED IN THIS SECTION. B. EACH TOWN THAT SO ELECTS TO PARTICIPATE SHALL BY RESOLUTION OF THE TOWN BOARD AUTHORIZE EXPENDITURE OF FUNDS FOR THE PURPOSE OF JOINT PURCHASE AND USE OF HIGHWAY EQUIPMENT. C. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, A VILLAGE PARTIALLY OR WHOLLY CONTAINED WITHIN A TOWN THAT PARTICIPATES IN A JOINT HIGHWAY EQUIPMENT PURCHASE SHALL NOT BE REQUIRED BUT MAY, BY RESOLUTION OF THE VILLAGE BOARD, ELECT TO PARTICIPATE IN A JOINT TOWN PURCHASE OF HIGHWAY EQUIPMENT.
