BILL NUMBER:A9777 TITLE OF BILL: An act to amend the tax law, in relation to the distrib- ution of monies collected from the public safety communications surcharge PURPOSE OR GENERAL IDEA OF BILL: This bill will establish an annual emergency communications competitive grant program in the amount of $25 million per year, commencing in FY 2010-11. SUMMARY OF SPECIFIC PROVISIONS: New York State Tax Law §186-f is amended to dedicate $25 million per year of funds generated by the public safety communications surcharge to a competitive grant program to assist county governments with costs associated with the maintenance and/or improve- ment of emergency communications systems. Priority would go to those grant applicants who propose system enhancements that are designed to achieve regional or statewide interoperability. JUSTIFICATION: The public safety communications surcharge was originally conceived as a funding mechanism for the statewide operation of a cellu- lar 911 telecommunications system and later, for the Statewide Wireless Network (SWN). After years of developing bid criteria, evaluating bid proposals, design and development, the state has cancelled the contract with M/A-COM for the development of the SWN after repeated test fail- ures. Any funds expended by the state towards the development of the SWN (approximately $51.5 million) are supposed to be reimbursed by M/A-CON.

CROUCH, ERRIGO, FIELDS, McKEVITT, MOLINARO, RABBITT, SAYWARD -- read once and referred to the Committee on Ways and Means AN ACT to amend the tax law, in relation to the distribution of monies collected from the public safety communications surcharge THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (d) and (e) of subdivision 6 of section 186-f of the tax law, as added by section 3 of part B of chapter 56 of the laws of 2009, are amended and a new paragraph (f) is added to read as follows: (d) Not less than the sum of ten million dollars annually must be disbursed pursuant to article six-A of the county law and appropriated by the legislature; [and] (e) To provide the costs of debt service for bonds and notes issued to finance expedited deployment funding pursuant to the provisions of section three hundred thirty-three of the county law and section sixteen hundred eighty-nine-h of the public authorities law[.]; AND (F) UP TO THE SUM OF TWENTY-FIVE MILLION DOLLARS SHALL BE AVAILABLE IN STATE FISCAL YEAR TWO THOUSAND TEN - TWO THOUSAND ELEVEN AND EACH FISCAL YEAR THEREAFTER, TO FUND A COMPETITIVE GRANT PROGRAM TO BE ADMINISTERED BY THE OFFICE FOR TECHNOLOGY, WITH GRANTS AWARDED TO ELIGIBLE COUNTY GOVERNMENTS FOR ASSISTANCE WITH COSTS ASSOCIATED WITH THE MAINTENANCE AND/OR IMPROVEMENT OF EMERGENCY COMMUNICATIONS SYSTEMS, WITH PREFERENCE GOING TO THOSE COUNTIES WHO PROPOSE SYSTEMS ENHANCEMENTS DESIGNED TO ACHIEVE REGIONAL OR STATEWIDE INTEROPERABILITY. THE OFFICE FOR TECHNOLO- GY SHALL ESTABLISH BY RULE OR REGULATION THE SPECIFIC CRITERIA TO BE USED IN JUDGING FROM AMONG THOSE PROPOSALS SUBMITTED EACH YEAR THOSE WHICH DESERVE FUNDING. S 2.
