BILL NUMBER:A9927 TITLE OF BILL: An act to amend the executive law, in relation to prohibiting automatic waivers of non-compliance with subcontracting goals, requiring agency periodic reporting and strengthening division reporting; to repeal subdivision 3 of section 315 of the executive law relating to responsibilities of contracting agencies; and to repeal the opening paragraph of subdivision (h) of section 121 of chapter 261 of the laws of 1988, amending the state finance law and other laws relating to the New York state infrastructure trust fund, relating to minority and women-owned business enterprises PURPOSE OR GENERAL IDEA OF BILL: To enhance provisions of law set forth in Article 15-a in efforts to enhance opportunities Minority and Women- Owned Business Enterprises. SUMMARY OF SPECIFIC PROVISIONS: Modifies the language of §313 of Article 15-a and creates a new subsection of §315, Paragraph 3 JUSTIFICATION: Studies have shown that while New York State has 8% of all women-owned business enterprises in the United States and 11% of all minority-owned business enterprises, minority and women-owned business enterprises only received 5.2* of expenditures on state contracts in 2006. In comparison to New York State, where minorities comprised 40% of the population, the State of Florida had a minority population of 38% and MWBE state contracting expenditures of approximately 25%, the State

BRODSKY -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to prohibiting automatic waivers of non-compliance with subcontracting goals, requiring agency periodic reporting and strengthening division reporting; to repeal subdivision 3 of section 315 of the executive law relating to respon- sibilities of contracting agencies; and to repeal the opening para- graph of subdivision (h) of section 121 of chapter 261 of the laws of 1988, amending the state finance law and other laws relating to the New York state infrastructure trust fund, relating to minority and women-owned business enterprises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 4 of section 313 of the execu- tive law, as amended by chapter 429 of the laws of 2009, is amended to read as follows: (a) Contracting agencies shall administer the rules and regulations promulgated by the director to ensure compliance with the provisions of this section. Such rules and regulations: shall require a contractor to submit a utilization plan after bids are opened, when bids are required, but prior to the award of a state contract; shall require the contract- ing agency to review the utilization plan submitted by the contractor and to post the utilization plan and any waivers of compliance issued pursuant to subdivision five of this section on the website of the contracting agency within a reasonable period of time as established by the director; shall require the contracting agency to notify the contractor in writing within a period of time specified by the director as to any deficiencies contained in the contractor's utilization plan; shall require remedy thereof within a period of time specified by the director; shall require the contractor to submit periodic compliance reports relating to the operation and implementation of any utilization EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
