BILL NUMBER:A9940 TITLE OF BILL: An act to amend the education law, in relation to information to be provided to students PURPOSE OF THE BILL: This bill requires each public senior high school to provide incoming students with information about sexual assault, domestic violence and stalking prevention measures. SUMMARY OF PROVISIONS: The education law is amended by adding a new section, 2815. Section 2815 will create informational programs for incoming high school students regarding sexual assault, domestic violence and stalking prevention measures. This program will be available to students through workshops, discussion groups, and film presentations. JUSTIFICATION: This legislation will simply provide students with basic information about the laws regarding sexual assault, domestic violence and stalking. Often times, students are ill-informed of these serious issues going into high school. This information will be crucial to helping students instill what is appropriate behavior at an early age. This program will also help students understand the common circumstances relating to sex offenses, incidents of domestic violence and stalking offenses on school

HYER-SPENCER -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to information to be provided to students THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 2815 to read as follows: S 2815. SEXUAL ASSAULT, DOMESTIC VIOLENCE AND STALKING PREVENTION INFORMATION. EACH PUBLIC SENIOR HIGH SCHOOL SHALL INFORM INCOMING STUDENTS ABOUT SEXUAL ASSAULT, DOMESTIC VIOLENCE AND STALKING PREVENTION MEASURES THROUGH PROGRAMS WHICH MAY INCLUDE WORKSHOPS, SEMINARS, DISCUSSION GROUPS, AND FILM PRESENTATIONS, IN ORDER TO DISSEMINATE INFORMATION, PROMOTE DISCUSSION, ENCOURAGE REPORTING, AND FACILITATE PREVENTION OF SEXUAL ASSAULT, DOMESTIC VIOLENCE AND STALKING. SUCH INFORMATION SHALL INCLUDE, BUT NOT BE LIMITED TO: 1. THE APPLICABLE LAWS, ORDINANCES, AND REGULATIONS RELATING TO SUCH OFFENSES; 2. THE PENALTIES FOR THE COMMISSION OF A SEX OFFENSE, A DOMESTIC VIOLENCE INCIDENT AND A STALKING OFFENSE; 3. THE PROCEDURES IN EFFECT IN THE SCHOOL DISTRICT OR BOARD OF COOPER- ATIVE EDUCATIONAL SERVICES FOR DEALING WITH SUCH OFFENSES; 4. THE AVAILABILITY OF COUNSELING AND OTHER SUPPORT SERVICES FOR THE VICTIMS OF SUCH OFFENSES; 5. THE NATURE OF AND COMMON CIRCUMSTANCES RELATING TO SEX OFFENSES, INCIDENTS OF DOMESTIC VIOLENCE AND STALKING OFFENSES ON SCHOOL PROPERTY; AND 6. THE METHODS THE SCHOOL DISTRICT OR BOARD OF COOPERATIVE EDUCATIONAL SERVICES EMPLOYS TO ADVISE AND TO UPDATE STUDENTS ABOUT SECURITY PROCE- DURES. S 2. This act shall take effect on the first of July next succeeding the date on which it shall have become a law.
