AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to combining the Nassau and New York city regional off-track
betting corporations into the Metropolitan off-track betting corpo-
ration; and to repeal certain provisions of such law relating thereto

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Legislative findings and intent. The legislature hereby
finds that the New York city off-track betting corporation (NYC OTB) and
Nassau county off-track betting corporation (Nassau OTB) are insolvent
and facing closure. The legislature further finds that nearly $1.1
billion dollars, almost half of all money wagered on horse racing in New
York state, is wagered through NYC OTB, and that nearly $250 million
dollars, almost twenty percent of all money wagered on horse racing in
New York state, is derived from wagering through Nassau OTB. The revenue
distributed to the racing industry, which is derived from wagering
through NYC OTB and Nassau OTB, plays an integral role in sustaining the
viability of the entire horse racing industry in New York state, and
together NYC OTB and Nassau OTB employ almost 2,000 people in the great-
er New York city-Nassau county metropolitan area. The legislature there-
fore determines that the continued operation of NYC OTB and Nassau OTB
under a combined corporate umbrella, to be known as the Metropolitan OTB
pursuant to sections 502 and 603 of the racing, pari-mutuel wagering and
breeding law, is of paramount importance to the public interest.
The legislature further finds that, since its inception in 1973, New
York's regional off-track betting system has provided state and local
governments with significant revenues to support government operations
and to aid in reducing increases in local property taxation. The
regional off-track betting system has been integrated into the state's
pari-mutuel racing and breeding industry to provide statewide accessi-
bility and exposure to New York's quality thoroughbred and harness
racing. Such accessibility and exposure has significantly contributed to
