BILL NUMBER: S1259
TITLE OF BILL :
An act to amend the education law, in relation to voting procedures
for school district meetings and elections
PURPOSE :
This bill requires that school districts require affirmation of
residency before voting on school district budgets and elections.
SUMMARY OF PROVISIONS :
Section 1 amends Section 2018-c of the Education Law to require all
persons voting at any school district meeting (budget vote) or
election to affirm that they have resided in the district for the last
30 days, are qualified to vote at the meeting or election, and provide
their signature, printed name and address. A technical amendment is
made to conform the list of items that can be used as proof of
residency to the federal Help America Vote Act of 2002.
Section 2 provides for the effective date.
JUSTIFICATION :
At present, school districts may adopt various requirements to ensure
that individuals are qualified to vote at district meetings and
elections, however, not all schools uniformly require even a signature
from voters as proof of residency, as is currently required for

AN ACT to amend the education law, in relation to voting procedures for
school district meetings and elections
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 2018-c of the education law, as added by chapter
775 of the laws of 1990, subdivision a as amended and such section as
renumbered by chapter 509 of the laws of 1991, is amended to read as
follows:
S 2018-c. Additional voting procedures. a. A school district may
require all persons offering to vote at any school district meeting or
election for which registration is not required, to provide one form of
proof of residency. Such form, to be determined by the school district,
may include, but is not limited to, a driver's license, a DEPARTMENT OF
MOTOR VEHICLES non-driver identification card OR OTHER CURRENT AND VALID
PHOTO IDENTIFICATION, a CURRENT utility bill, BANK STATEMENT, GOVERNMENT
CHECK, PAYCHECK OR OTHER GOVERNMENT DOCUMENT THAT SHOWS THE NAME AND
ADDRESS OF THE VOTER or a voter registration card. [Upon offer of proof
of residency, a school district may also require all persons offering to
vote to provide their signature, printed name, and address.]
b. [As an alternative to voting procedures provided for in section
twenty hundred fourteen of this article and subdivision a of this
section, a school district may require all persons offering to vote at
any school district meeting or election to provide their signature,
printed name, and address] ALL SCHOOL DISTRICTS SHALL REQUIRE ALL
PERSONS OFFERING TO VOTE AT ANY SCHOOL DISTRICT MEETING OR ELECTION TO
EXECUTE AN AFFIRMATION STATING: "I DO DECLARE AND AFFIRM THAT I AM AND
HAVE BEEN, FOR THIRTY DAYS LAST PAST, AN ACTUAL RESIDENT OF THIS SCHOOL
DISTRICT AND THAT I AM QUALIFIED TO VOTE AT THIS MEETING OR ELECTION",
AND TO PROVIDE THEIR SIGNATURE, PRINTED NAME AND ADDRESS.
S 2. This act shall take effect on the thirtieth day after it shall
have become a law.
