  vation

AN ACT to amend the  environmental  conservation  law,  in  relation  to
  protection of state lands and coastal erosion hazard areas

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision  2  of  section  9-0303  of  the  environmental
conservation  law  is amended and a new subdivision 2-a is added to read
as follows:
  2. Structures, FIXTURES AND IMPROVEMENTS.   No  [building]  STRUCTURE,
IMPROVEMENT OR FIXTURE shall be erected, used [or], maintained [upon] OR
ABANDONED  ON  state lands except [under permits from] AS the department
MAY AUTHORIZE.
  2-A. ABANDONMENT AND STORAGE OF  PROPERTY.  NO  PERSON  SHALL  ABANDON
PROPERTY  ON  STATE  LANDS, OR MAINTAIN OR STORE PROPERTY ON STATE LANDS
EXCEPT AS THE DEPARTMENT MAY AUTHORIZE.
  S 2. Section 71-0703 of the environmental conservation law is  amended
by adding a new subdivision 9 to read as follows:
  9.  A.  ANY  PERSON  WHO  VIOLATES  ANY  PROVISION OF, OR WHO FAILS TO
PERFORM ANY DUTY IMPOSED BY, SUBDIVISION 2 OF  SECTION  9-0303  OF  THIS
CHAPTER  OR  ANY RULE OR REGULATION PROMULGATED PURSUANT TO ARTICLE 9 OF
THIS CHAPTER PERTAINING TO THE ERECTION, USE, MAINTENANCE OR ABANDONMENT
OF A STRUCTURE, IMPROVEMENT OR FIXTURE ON STATE LANDS, OR  ANY  TERM  OR
CONDITION  OF ANY LICENSE, PERMIT OR OTHER AUTHORIZATION ISSUED PURSUANT
TO SUBDIVISION 2 OF SECTION 9-0303 OF THIS CHAPTER, OR ANY FINAL  DETER-
MINATION OR ORDER RELATING THERETO MADE PURSUANT TO THIS TITLE, SHALL BE
LIABLE  FOR  A  CIVIL PENALTY OF NOT MORE THAN FIVE THOUSAND DOLLARS FOR
EACH VIOLATION AND AN ADDITIONAL CIVIL PENALTY  OF  NOT  MORE  THAN  ONE
THOUSAND  DOLLARS  FOR  EACH  DAY DURING WHICH SUCH VIOLATION CONTINUES,
AND, IN ADDITION THERETO, SUCH PERSON MAY BE  ENJOINED  FROM  CONTINUING
