BILL NUMBER: S1726
TITLE OF BILL :
An act to amend the executive law, in relation to opportunities for
utilization of minority and women-owned businesses by state agencies
PURPOSE OF THE BILL :
This bill would expand the State's efforts to include minority and
women-owned businesses in the contracting process for improvements on
real property owned by State agencies, by broadening the definition of
"state contracts" to include ground leases.
SUMMARY OF PROVISIONS :
Section 1 of the bill amends Executive Law § 313 to include leases by
State agencies that provide for the improvement of real property by
the lessees within the definition of "state contracts" for which
contractors must provide opportunities for meaningful participation of
minority and women-owned business enterprises.
Section 2 of the bill provides for an immediate effective date.

AN ACT to amend the executive law, in relation to opportunities for
utilization of minority and women-owned businesses by state agencies
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 313 of the executive law is amended by adding a new
subdivision 2-a to read as follows:
2-A. FOR PURPOSES OF THIS SECTION STATE CONTRACTS SHALL INCLUDE, WITH-
OUT LIMITATION, LEASES OF REAL PROPERTY BY A STATE AGENCY TO A LESSEE
WHERE THE TERMS OF SUCH LEASES PROVIDE FOR CONSTRUCTION, DEMOLITION,
REPLACEMENT, MAJOR REPAIR OR RENOVATION OF REAL PROPERTY AND IMPROVE-
MENTS THEREON BY SUCH LESSEE. REPORTS TO THE DIRECTOR PURSUANT TO
SECTION THREE HUNDRED FIFTEEN OF THIS ARTICLE SHALL INCLUDE ACTIVITIES
WITH RESPECT TO ALL SUCH STATE CONTRACTS.
S 2. This act shall take effect on the thirtieth day after it shall
have become a law; provided, however, that the amendment to section 313
of the executive law made by section one of this act shall not affect
the expiration of such section and shall be deemed to expire therewith.
