BILL NUMBER: S1773 TITLE OF BILL : An act to amend the insurance law, in relation to coverage for breast reconstruction surgery after a partial mastectomy or lumpectomy PURPOSE : To provide insurance coverage for reconstruction for all mastectomies and lumpectomies. SUMMARY OF PROVISIONS : Amends Insurance Law section: §3216(20)(A)(i) §3221(k)(10)(i) §4303(x)(1)(A) EXISTING LAW : Insurance presently covers reconstruction for mastectomies but partial and lumpectomies are not similarly covered. JUSTIFICATION : Women who undergo the partial loss of a breast should have the same option of reconstruction surgery as those presently covered.

LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to coverage for breast reconstruction surgery after a partial mastectomy or lumpectomy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph and clause (i) of subparagraph (A) of paragraph 20 of subsection (i) of section 3216 of the insurance law, as added by chapter 21 of the laws of 1997, are amended to read as follows: Every policy which provides medical, major medical, or similar compre- hensive-type coverage shall provide the following coverage for breast reconstruction surgery after a mastectomy, PARTIAL MASTECTOMY OR LUMPEC- TOMY: (i) all stages of reconstruction of the breast on which the mastectomy, PARTIAL MASTECTOMY OR LUMPECTOMY has been performed; and S 2. The opening paragraph and clause (i) of subparagraph (A) of para- graph 10 of subsection (k) of section 3221 of the insurance law, as added by chapter 21 of the laws of 1997, are amended to read as follows: Every group or blanket policy delivered or issued for delivery in this state which provides medical, major medical, or similar comprehensive- type coverage shall provide the following coverage for breast recon- struction surgery after a mastectomy, PARTIAL MASTECTOMY OR LUMPECTOMY: (i) all stages of reconstruction of the breast on which the mastectomy, PARTIAL MASTECTOMY OR LUMPECTOMY has been performed; and S 3. The opening paragraph and subparagraph (A) of paragraph 1 of subsection (x) of section 4303 of the insurance law, as added by chapter 21 of the laws of 1997, are amended to read as follows: Every contract issued by a medical expense indemnity corporation, hospital service corporation or health service corporation which provides coverage for surgical or medical care shall provide the follow- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
