BILL NUMBER: S1885 TITLE OF BILL : An act to amend the education law, in relation to notification of parents and guardians PURPOSE : To provide a mechanism for notifying parents and guardians of life threatening events which have taken place at the schools attended by their children. SUMMARY OF PROVISIONS : Section 1. Adds a new subdivision 42 to Section 305 of the Education Law which requires that every school notify the parents and guardians of its students whenever life threatening incidents have occurred on campus. Section 2. Provides for an effective date of one hundred twenty days after the bill becomes law. JUSTIFICATION : Unfortunately, we have recently seen a steady rise in school violence. A consistent factor cited as part of this problem is a lack of communication between perpetrators and adult role models. There is much that needs to be done to address this problem. KLEIN, BRESLIN, DIAZ, DUANE, HASSELL-THOMPSON, ONORATO, SAMPSON, SMITH -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to notification of parents and guardians THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 42 to read as follows: 42. THE COMMISSIONER IS AUTHORIZED AND DIRECTED TO PROMULGATE RULES AND REGULATIONS TO REQUIRE ALL SCHOOL DISTRICTS TO ESTABLISH A PROGRAM TO NOTIFY PARENTS OR GUARDIANS OF SCHOOL CHILDREN WHEN POTENTIALLY LIFE THREATENING OCCURRENCES HAVE TAKEN PLACE ON SCHOOL GROUNDS. FOR PURPOSES OF THIS SUBDIVISION LIFE THREATENING OCCURRENCES SHALL INCLUDE, BUT NOT BE LIMITED TO, BOMB THREATS AND THE DISCOVERY OR RECOVERY OF GUNS OR OTHER WEAPONS FROM STUDENTS. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately the commissioner of education is authorized to promulgate such rules and regulations as may be necessary to carry out the provisions of this act on its effective date.
