  GOMERY, ONORATO, SAMPSON, SMITH -- read twice and ordered printed, and
  when printed to be committed to the Committee on Consumer Protection

AN  ACT  to  amend  the  general  business law and the executive law, in
  relation to prohibiting the use of unsafe children's products; prohib-
  iting child care facilities from using or having on the facility prem-
  ises unsafe children's products;  prescribing  powers  and  duties  of
  certain agencies; and providing for the promulgation of rules to carry
  out the provisions of this act

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general business law is amended by adding a new article
12-A to read as follows:
                               ARTICLE 12-A
                     NEW YORK INFANT CRIB SAFETY ACT
SECTION 211.   SHORT TITLE.
        211-A. DEFINITIONS.
        211-B. UNSAFE CHILDREN'S PRODUCTS; PROHIBITION.
        211-C. LIST OF UNSAFE CHILDREN'S PRODUCTS.
        211-D. UNSAFE CHILDREN'S PRODUCTS; CHILD CARE.
        211-E. RETROFITS.
        211-F. EXCEPTION.
        211-G. ENFORCEMENT.
        211-H. REMEDIES.
  S 211. SHORT TITLE. THIS ARTICLE MAY BE CITED AS THE "NEW YORK  INFANT
CRIB SAFETY ACT".
  S 211-A. DEFINITIONS. FOR THE PURPOSES OF THIS ARTICLE:
  (A) "CHILDREN'S PRODUCT" MEANS A PRODUCT, INCLUDING BUT NOT LIMITED TO
A FULL-SIZE CRIB, NON-FULL-SIZE CRIB, TODDLER BED, BED, CAR SEAT, CHAIR,
HIGH  CHAIR,  BOOSTER  CHAIR,  HOOK-ON  CHAIR,  BATH SEAT, GATE OR OTHER
ENCLOSURE FOR CONFINING A CHILD, PLAY YARD, STATIONARY ACTIVITY  CENTER,
