  printed to be committed to the Committee on Higher Education

AN ACT to amend the education law, in  relation  to  permitting  out-of-
  state visiting and appointed faculty to perform acupuncture in accred-
  ited program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivisions 5 and 7 of section 8216 of the education  law,
as  added  by  chapter  772  of the laws of 1990, are amended to read as
follows:
  (5) Any person who is pursuing qualification for licensure  through  a
course of formal study pursuant to this article may practice acupuncture
without  a license, provided such practice is limited to such study; AND
ANY PERSON APPOINTED TO THE FACULTY OF A PROGRAM OFFERING  A  COURSE  OF
FORMAL STUDY MAY PRACTICE ACUPUNCTURE WITHOUT A LICENSE DURING THE PERI-
OD  OF  SUCH  APPOINTMENT,  AND  FURTHER  PROVIDED THAT SUCH PRACTICE IS
LIMITED TO RESEARCH, STUDY AND  TRAINING  REQUIRED  FOR  THE  COURSE  OF
FORMAL STUDY OR CONTINUING EDUCATION COURSES.
  (7) Any person who is pursuing qualification for certification through
a  formal  course  of  study  in  a  registered  program  and any person
appointed to the faculty of such program may practice acupuncture  with-
out  a license, provided that such practice is limited to such research,
study and training.   THIS EXEMPTION SHALL ALSO  APPLY  TO  OUT-OF-STATE
VISITING FACULTY WHO PERFORM ACUPUNCTURE IN AN ACCREDITED PROGRAM.
  S 2. This act shall take effect immediately.
