BILL NUMBER: S246 TITLE OF BILL : An act in relation to authorizing the town of Schroeppel to repay to taxpayers monies erroneously received by such town as a result of overpaid special assessments PURPOSE : Authorizes the town of Schroeppel in Oswego County to repay to taxpayers monies erroneously received by such town as a result of overpaid special assessments. SUMMARY OF PROVISIONS : Authorizes repayment of monies to certain taxpayers of funds erroneously received by the town of Schroeppel as a result of taxes collected pursuant to the 2005 assessment roll based on inaccurate information. JUSTIFICATION : The 2005 town budget was adopted and submitted to the Oswego County Treasurer containing transcriptional errors on the summary page for three water districts and one sewer district in the town of Schroeppel. The error involved applying amounts that should have been general obligations of the town to the respective districts, thus increasing the unit charge that appeared on the respective tax bills.

AUBERTINE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to authorizing the town of Schroeppel to repay to taxpayers monies erroneously received by such town as a result of overpaid special assessments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, the town of Schroeppel, county of Oswego, is hereby authorized and directed to refund or credit monies erroneously received by such town as a result of special assessments collected pursuant to the 2005 assessment roll which was prepared on the basis of erroneous budget figures used to fund water district #1, water district #2, water district #3 and sewer district #2 within such town. Such monies erroneously received and to be repaid by the town of Schroeppel shall be any monies collected by the county of Oswego for such town and received by such town above the amount of monies desired to be received by such town for each such district, as set forth in the following table: 2005 BUDGET DESIRED DIFFERENCE TO DISTRICT AMOUNT ($) AMOUNT ($) BE REPAID ($) Water District #1 12,979.51 4,766.85 8,212.66 Water District #2 14,696.07 6,972.98 7,723.09 Water District #3 8,390.17 2,826.39 5,563.78 Sewer District #2 3,041.50 546.56 2,494.94 Such repayment of monies shall be made pursuant to a resolution adopted by the town board of the town of Schroeppel, and shall be made only to taxpayers who overpaid taxes as a result of such erroneously prepared budget and only to the extent that such current owner overpaid such taxes. S 2. This act shall take effect immediately.
