AN ACT to amend the penal law, in relation to imposing mandatory minimum
sentences of imprisonment upon persons convicted of theft offenses
involving motor vehicles
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The penal law is amended by adding a new section 60.36 to
read as follows:
S 60.36 AUTHORIZED DISPOSITIONS; THEFT OFFENSES INVOLVING MOTOR VEHI-
CLES.
WHEN A PERSON IS TO BE SENTENCED UPON A CONVICTION OF THE CRIME OF
GRAND LARCENY IN THE FOURTH DEGREE AS DEFINED IN SUBDIVISION EIGHT OF
SECTION 155.30 OF THIS CHAPTER OR CRIMINAL POSSESSION OF STOLEN PROPERTY
IN THE FOURTH DEGREE AS DEFINED BY SUBDIVISION FIVE OF SECTION 165.45 OF
THIS CHAPTER, THE COURT MUST SENTENCE THE DEFENDANT TO A MANDATORY MINI-
MUM TERM OF IMPRISONMENT OF SIX MONTHS.
S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
