AN ACT to amend the public health law, in relation to  establishing  the
  New York state healthy community program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public health law is amended by adding  a  new  section
2704 to read as follows:
  S  2704.  NEW YORK STATE HEALTHY COMMUNITY PROGRAM. 1. THERE IS HEREBY
ESTABLISHED WITHIN THE DEPARTMENT THE NEW YORK STATE  HEALTHY  COMMUNITY
PROGRAM. THIS PROGRAM SHALL PROMOTE COMMUNITY-BASED APPROACHES TO CHRON-
IC  DISEASE PREVENTION AND CONTROL, BUILDING ON THE SUCCESS OF THE MODEL
COMMUNITIES IN THE FEDERAL STEPS TO A HEALTHIER NY PROGRAM.
  2. THE DEPARTMENT, IN DEVELOPING THE NEW YORK STATE HEALTHY  COMMUNITY
PROGRAM, SHALL:
  (A)  SOLICIT  APPLICATIONS FROM LOCAL PUBLIC HEALTH AGENCIES, APPLYING
IN CONJUNCTION WITH MULTIPLE LOCAL PARTNERS;
  (B) AWARD MULTI-YEAR CONTRACTS TO SUCCESSFUL APPLICANTS;
  (C) ADMINISTER CONTRACTS;
  (D) COORDINATE WITH OTHER PUBLIC HEALTH, EDUCATION, AND OTHER RELEVANT
AGENCIES AND PROGRAMS;
  (E) PROMOTE THE PREVENTION AND  CONTROL  OF  CHRONIC  DISEASE  THROUGH
EVIDENCE-BASED STRATEGIES;
  (F) OFFER PROFESSIONAL EDUCATION ACTIVITIES IN FUNDED COMMUNITIES; AND
  (G)  PROVIDE  TECHNICAL ASSISTANCE TO LOCAL PUBLIC HEALTH AGENCIES AND
OTHER LOCAL PARTNERS IN THE PROGRAM.
  3. THE COMMISSIONER SHALL ACCEPT AND EXPEND  ANY  GRANTS,  AWARDS,  OR
OTHER  FUNDS OR APPROPRIATIONS AS MAY BE MADE AVAILABLE FOR THE PURPOSES
OF THE NEW YORK STATE HEALTHY COMMUNITY PROGRAM, SUBJECT TO THE  LIMITA-
TIONS  AS  TO  THE  APPROVAL OF EXPENDITURES AND AUDIT AS PRESCRIBED FOR
STATE FUNDS BY THE STATE FINANCE LAW.  UP  TO  FIFTEEN  PERCENT  OF  ALL
APPROPRIATIONS  FOR THIS PROGRAM WILL BE TRANSFERABLE TO THE STATE OPER-
ATIONS ACCOUNT FOR THE ADMINISTRATION OF THIS PROGRAM.
  S 2. This act shall take effect immediately.
