AN ACT to authorize the city of North Tonawanda to alienate  and  convey
  certain waterfront real property

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding the provisions of subdivision 2 of  section
20  of  the  general  city  law,  the  city of North Tonawanda is hereby
authorized, acting by and through its legislative body, to alienate  and
convey  the waterfront real property owned by such city and described in
section three of this act.
  S 2. The authorization contained in section one of this act shall take
effect only upon the condition that the city of North Tonawanda dedicate
an amount equal to or greater than the fair market value of the property
being alienated in section three of this act toward acquisition of addi-
tional waterfront  property  and/or  capital  improvements  to  existing
waterfront property.
  S  3.  The  parcel  of land authorized to be alienated and conveyed by
section one of this act is more fully described as follows:
  ALL THAT PIECE OR PARCEL OF LAND owned by the City of North  Tonawanda
situated  on the Niagara River Front on the Northerly side of River Road
in said City of North Tonawanda and lying West of  the  Westerly  inter-
section  of  Felton  Street  and  River Road in said City, consisting of
approximately two and three tenths (2.3) acres exclusive of  water  area
and being formerly leased to one LAWRENCE WARDELL AND GERALD WARDELL and
the  RIVERSIDE  PARK  MARINE, INC. being known as 1000 River Road, North
Tonawanda, New York and described on the City  Assessor's  maps  of  the
City  of  North  Tonawanda as Parcel 2-48-62 and being more particularly
described as follows:
  BEGINNING at a point on the westerly side of  River  Road  such  point
being located three hundred and twenty feet (320') north of the lot line
