BILL NUMBER: S3024 TITLE OF BILL : An act to amend the navigation law, in relation to the wearing of personal flotation devices when underway on a pleasure vessel less than twenty-one feet PURPOSE OF THE BILL : The purpose of this bill is to clarify legal requirements concerning the use of a personal flotation device (PFD) on pleasure vessels, and decrease boating-related injuries and fatalities by requiring the use of PFDs on small vessels during the months of the year when water temperatures are at their coldest. SUMMARY OF PROVISIONS : This bill amends Navigation Law § 40 by adding a new paragraph (e) to subdivision 1 to prohibit owners and operators of certain pleasure vessels from permitting the operation of such vessels between November 1 and May 1 unless each passenger is wearing a PFD when the vessel is underway. THOMPSON -- (at request of the Office of Parks, Recreation and Historic Preservation) -- read twice and ordered print- ed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the navigation law, in relation to the wearing of personal flotation devices when underway on a pleasure vessel less than twenty-one feet THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The subdivision heading of subdivision 1 of section 40 of the navigation law, as amended by chapter 74 of the laws of 1998, is amended to read as follows: [personal] PERSONAL flotation devices. S 2. Subdivision 1 of section 40 of the navigation law is amended by adding a new paragraph (e) to read as follows: (E) NO OWNER OR OPERATOR OF A PLEASURE VESSEL LESS THAN TWENTY-ONE FEET, INCLUDING ROWBOATS, CANOES, AND KAYAKS SHALL PERMIT ITS OPERATION, BETWEEN NOVEMBER FIRST AND MAY FIRST, UNLESS EACH PERSON ON BOARD SUCH VESSEL IS WEARING A SECURELY FASTENED UNITED STATES COAST GUARD APPROVED WEARABLE PERSONAL FLOTATION DEVICE OF AN APPROPRIATE SIZE WHEN SUCH VESSEL IS UNDERWAY. S 3. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
