BILL NUMBER: S3077 TITLE OF BILL : An act to amend the penal law, in relation to establishing the offense of disruption of a sports contest PURPOSE OR GENERAL IDEA OF BILL : Establishes the class A misdemeanor of disruption of a sports contest. SUMMARY OF SPECIFIC PROVISIONS : Section one amends the penal law by adding a new section 240.23, disruption of a sports contest. JUSTIFICATION : To deter rowdy fans from harming players and disrupting family sporting events. This bill would establish a class A misdemeanor for disrupting a sports contest when he or she, with the intent to cause annoyance, alarm or physical injury to a sport participant or sports official throws or drops any object onto the field of play at a sports contest. This bill will deter fans from throwing projectiles onto the field like the dozens of incidents that occurred during the 2004 Major League Baseball season. VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to establishing the offense of disruption of a sports contest THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 240.23 to read as follows: S 240.23 DISRUPTION OF A SPORTS CONTEST. A PERSON IS GUILTY OF DISRUPTION OF A SPORTS CONTEST WHEN, NOT BEING A SPORTS PARTICIPANT AS DEFINED IN SUBDIVISION TWO OF SECTION 180.35 OF THIS PART, HE OR SHE, WITH INTENT TO CAUSE ANNOYANCE, ALARM OR PHYSICAL INJURY TO A SPORT PARTICIPANT OR SPORTS OFFICIAL AS DEFINED IN SUBDIVI- SION THREE OF SECTION 180.35 OF THIS PART, CAUSES AN OBJECT TO BE PROJECTED ONTO THE FIELD OF PLAY OF A SPORTS CONTEST AS DEFINED IN SUBDIVISION ONE OF SECTION 180.35 OF THIS PART. DISRUPTION OF A SPORTS CONTEST IS A CLASS A MISDEMEANOR. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become law.
