BILL NUMBER: S3090 TITLE OF BILL : An act to amend the penal law, in relation to creating the crime of criminal trespass on the field of play of a sports event PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to better protect players, umpires, and fans that attend professional sporting events in New York State. SUMMARY OF SPECIFIC PROVISIONS : This bill would add a new section 140.18 to the penal law that would make it a class B misdemeanor for criminal trespass on the field of play. Specifically, a person would be guilty of criminal trespass on the field of play when he or she enters or remains unlawfully on the field of play with intent to harm a person (basic assault), damage property (criminal mischief), or steal (theft). "Field of play" is defined as the location of a professional sporting event or sporting event for which admission is charged. JUSTIFICATION : Increasingly, professional sporting events are interrupted by unruly fans that run onto the field during a game. In fact, during a recent game between the Chicago White Sox and the Kansas City Royals, 4 fans interrupted the game by running onto the field, with one fan attacking

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to creating the crime of criminal trespass on the field of play of a sports event THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 140.18 to read as follows: S 140.18 CRIMINAL TRESPASS ON THE FIELD OF PLAY OF A SPORTS EVENT. A PERSON IS GUILTY OF CRIMINAL TRESPASS ON THE FIELD OF PLAY OF A SPORTS EVENT WHEN SUCH PERSON KNOWINGLY ENTERS OR REMAINS UNLAWFULLY ON THE FIELD OF PLAY OF A SPORTS EVENT NOT OTHERWISE OPEN TO THE PUBLIC, WHILE SUCH EVENT IS BEING PLAYED OR DURING WHICH TIME THE FIELD OF PLAY IS BEING UTILIZED BY PARTICIPANTS IN SUCH SPORTS ACTIVITY, WITH THE INTENT TO VIOLATE SECTION 120.00, 145.00 OR 155.25 OF THIS CHAPTER. FOR PURPOSES OF THIS SECTION, "FIELD OF PLAY OF A SPORTS EVENT" SHALL MEAN THE LOCATION UPON WHICH A PROFESSIONAL SPORTING EVENT OR SPORTING EVENT FOR WHICH ADMISSION IS CHARGED TO THE PUBLIC IS PLAYED. CRIMINAL TRESPASS ON THE FIELD OF PLAY OF A SPORTS EVENT IS A CLASS B MISDEMEANOR. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
