BILL NUMBER: S3106 TITLE OF BILL : An act to amend the town law, in relation to authorizing the town of Ramapo, in the county of Rockland to elect four town justices PURPOSE : The purpose of the bill to allow the town of Ramapo to hold an election of a fourth town justice. SUMMARY OF PROVISIONS : Section 1 of the amends subdivision 1 of section 20 of the town laws by adding paragraph 0, as it relates to allowing the town board of Ramapo in the county of Rockland to adopt a resolution at least one hundred fifty days prior to any biennial town election determining that such town shall have four town justices. The town board may also adopt a resolution creating an immediate vacancy to serve until December 31st of that year. JUSTIFICATION : The town of Ramapo has seen an increase in the volume of court work over the past several years. The town court is the 13th busiest court in the state. They currently operate with three judges in its justice court and have requested a fourth judge. The increase in court work has severely impacted customer service resulting in large lines and delays for court appearances. A fourth judge would alleviate the

MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law, in relation to authorizing the town of Ramapo, in the county of Rockland to elect four town justices THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 20 of the town law is amended by adding a new paragraph (o) to read as follows: (O) NOTWITHSTANDING THE PROVISIONS OF ANY GENERAL, SPECIAL OR LOCAL LAW TO THE CONTRARY, THE TOWN BOARD OF THE TOWN OF RAMAPO, COUNTY OF ROCKLAND, MAY ADOPT A RESOLUTION AT LEAST ONE HUNDRED FIFTY DAYS PRIOR TO ANY BIENNIAL ELECTION DETERMINING THAT SUCH TOWN SHALL HAVE FOUR TOWN JUSTICES. IF THE TOWN BOARD OF SUCH TOWN SHALL HAVE ADOPTED SUCH A RESOLUTION, THE ELECTORS OF SUCH TOWN SHALL ELECT AT THE SUCCEEDING BIENNIAL ELECTION, AND QUADRENNIALLY THEREAFTER, SUCH ADDITIONAL TOWN JUSTICE FOR A TERM OF FOUR YEARS BEGINNING THE FIRST DAY OF JANUARY NEXT SUCCEEDING SUCH BIENNIAL TOWN ELECTION. IF THE TOWN BOARD OF THE TOWN OF RAMAPO HAS ADOPTED SUCH RESOLUTION, IT MAY ALSO ADOPT A RESOLUTION CREATING AN IMMEDIATE VACANCY IN THE POSITION OF THE FOURTH JUSTICE, AND IT MAY APPOINT SOMEONE TO FILL THE VACANCY TO SERVE UNTIL DECEMBER THIR- TY-FIRST OF THAT YEAR.
