BILL NUMBER: S3451 TITLE OF BILL : An act to amend the municipal home rule law, in relation to requiring that certain local laws be subject to a mandatory referendum PURPOSE : This bill provides that any change to a law that has previously been voted on by referendum be subject to further referenda before any such change can take effect. SUMMARY OF PROVISIONS :Adds new paragraph 1 to subdivision 2 of section 23 of the municipal home rule law to change a provision of the law that has previously been voted on by the people through a referendum. JUSTIFICATION : The purpose of a referendum is to provide the full electorate with an opportunity to have a direct input to either accept or reject a particular proposal. This legislation would ensure that any referendum voted on by people in the past must be voted on by referendum again prior to any changes being made. LEGISLATIVE HISTORY : New bill. FISCAL IMPLICATIONS : None. EFFECTIVE DATE : This act shall take effect immediately.

SCHNEIDERMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the municipal home rule law, in relation to requiring that certain local laws be subject to a mandatory referendum THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 23 of the municipal home rule law is amended by adding a new paragraph 1 to read as follows: L. CHANGES A PROVISION OF LAW THAT HAS PREVIOUSLY BEEN VOTED ON BY THE PEOPLE THROUGH A REFERENDUM. S 2. This act shall take effect immediately.
