AN  ACT  to  amend  the  public  health  law,  in  relation to access to
  prescription drug coverage

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
2804-b to read as follows:
  S 2804-B. RESIDENTIAL HEALTH CARE FACILITIES; ACCESS  TO  PRESCRIPTION
DRUG  COVERAGE  UNDER  THE  ELDERLY  PHARMACEUTICAL  INSURANCE  COVERAGE
PROGRAM. A RESIDENTIAL HEALTH CARE FACILITY SHALL ENSURE THAT A RESIDENT
WHO IS ENROLLED IN THE ELDERLY PHARMACEUTICAL INSURANCE COVERAGE PROGRAM
(EPIC) UNDER TITLE THREE OF ARTICLE TWO OF THE ELDER LAW SHALL HAVE  THE
OPPORTUNITY  TO  ACCESS  PRESCRIPTION  DRUG  COVERAGE UNDER EPIC FOR ANY
COVERED DRUGS, AS DEFINED IN SUBDIVISION  ONE  OF  SECTION  TWO  HUNDRED
FORTY-ONE OF THE ELDER LAW, DISPENSED TO THE RESIDENT BY THE RESIDENTIAL
HEALTH CARE FACILITY.
  S  2. This act shall take effect on the first of January next succeed-
ing the date on which it shall have become a law.
