2009-S3966 (ACTIVE) - Summary

Empowers fire district commissioners to acquire (by purchase, lease, gift, devise or condemnation) real property, and to erect, construct, alter, repair and equip suitable buildings for the purpose of housing use by firefighters and residents of the district; provides the commissioners shall cause to be submitted, at a special or annual fire district election, a proposition to lease, purchase, construct, reconstruct, alter, repair or equip such buildings for such housing use.

AN ACT to amend the town law, in relation to the powers of fire district
  commissioners to obtain housing

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision 14 of section 176 of the town law, as amended
by chapter 645 of the laws of 1935, is amended to read as follows:
  14. For the preservation, protection and storing of fire apparatus and
equipment and for the social, HOUSING and recreational use of the [fire-
men] FIREFIGHTER and residents of  the  district  and  for  any  of  the
purposes authorized by law, may acquire by purchase, lease, gift, devise
or  by  condemnation,  real property and erect, construct, alter, repair
and equip suitable buildings, and may  furnish  necessary  supplies  for
such  purposes,  and  may  lease  portions thereof not required for fire
district purposes. All real property required by any fire  district  for
any  purpose  authorized  by this article shall be deemed to be required
for public use and may be acquired by such fire district.
  S 2. Paragraph (c) of subdivision 1 of section 179 of the town law, as
amended by chapter 565 of the laws  of  1949,  is  amended  to  read  as
follows:
  (c)    To  lease,  purchase,  construct, reconstruct, alter, repair or
equip suitable buildings for the preservation, protection and storing of
vehicles, apparatus and equipment of  the  fire  district  and  for  the
social,  HOUSING  and recreational use of the [firemen] FIREFIGHTERS and
residents of the district, and purchase the necessary lands therefor.
  S 3. This act shall take effect immediately.
