BILL NUMBER: S4004
TITLE OF BILL :
An act to amend the insurance law, in relation to prohibiting insurers
from discriminating on the basis of county of residence
PURPOSE :
To protect seniors from losing health coverage due to the lack of
profit for the insurer based on differing county reimbursements.
SUMMARY OF PROVISIONS :
This bill amends the insurance law by adding a new section 2607-a.
JUSTIFICATION :
Health Maintenance Organizations have been fleeing various counties
over the last year leaving thousands of senior citizens stranded with
no prescription drug coverage. The problem has been very acute in
counties such as Suffolk where only two such HMOs remain. Due to
arbitrary differences in reimbursement from the federal government
from county to county for these health care organizations, many such
organizations have stopped doing business in various counties.
Insurance companies should not be able to cherry pick in this regard,
leaving some counties covered while seniors in others are left to have
to pay for their prescriptions out of their pockets. This bill would
require that health insurance companies that cover in one part of the

AN ACT to amend the insurance law, in relation to prohibiting insurers
from discriminating on the basis of county of residence
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The insurance law is amended by adding a new section 2607-a
to read as follows:
S 2607-A. DISCRIMINATION BECAUSE OF COUNTY OF RESIDENCE. NO INDIVIDUAL
OR ENTITY SHALL REFUSE TO ISSUE ANY HEALTH INSURANCE POLICY, OR CANCEL
OR DECLINE TO RENEW SUCH POLICY FOR AN INDIVIDUAL WHO IS OVER THE AGE OF
SIXTY-TWO BECAUSE OF THE COUNTY OF RESIDENCE OF THE APPLICANT OR POLICY-
HOLDER OR DUE TO REIMBURSEMENT RATES DETERMINED BY THE FEDERAL GOVERN-
MENT.
S 2. This act shall take effect immediately and shall apply to any
policy application or policy issued, amended or renewed on or after such
date.
