BILL NUMBER: S4008 TITLE OF BILL : An act to amend the town law, in relation to authorizing fire commissioners of volunteer fire departments to receive compensation PURPOSE : To compensate fire commissioners of volunteer fire departments. SUMMARY OF PROVISIONS : Section 1: Amends subdivision 3 of Section 174 of the Town Law to allow fire district commissioners to be compensated for their services. Section 2: provides for an immediate effective date. JUSTIFICATION : The duties of fire commissioners of volunteer fire departments have increased over the years. In order to keep these experienced commissioners from leaving, they deserve compensation for the long hours that they put in protecting the safety of all in their area. LEGISLATIVE HISTORY :

MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law, in relation to authorizing fire commis- sioners of volunteer fire departments to receive compensation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 174 of the town law, as amended by chapter 670 of the laws of 2002, is amended to read as follows: 3. The fire district commissioners [shall] MAY receive [no] compen- sation for their services, [but] AND a commissioner acting as secretary of the fire district may ALSO be compensated. The fire district secre- tary shall receive such compensation as the fire district commissioners may determine, but if the secretary be a member of the board of fire commissioners his OR HER compensation shall be fixed by the other members of the board. The fire district treasurer and the director of purchasing, when such office has been established, shall receive such compensation as the fire district commissioners may determine. Each fire district treasurer, each secretary in fire districts having a separate secretary, and each director of purchasing, when such office has been established, shall before entering upon the duties of his OR HER office take the constitutional oath of office and file the same with the town clerk of the town or one of the towns in which such fire district is located. The treasurer of each fire district shall before entering upon the duties of his OR HER office, execute and file with the town clerk of the town or one of the towns in which such fire district is located, an official undertaking, conditioned for the faithful performance of his OR HER duties and that he OR SHE will and truly keep, pay over and account for all moneys of the fire district coming into his OR HER hands as treasurer of the fire district.
