BILL NUMBER: S4009 TITLE OF BILL : An act to amend the family court act, in relation to granting jurisdiction over qualified domestic relation orders in child support proceedings PURPOSE : This bill gives Family Court jurisdiction over qualified domestic relation orders in child support proceedings. SUMMARY OF PROVISIONS : Section 1: Amends Section 411 of the Family Court Act to include qualified domestic relations orders in child support proceedings within the Family court's jurisdiction. Section 2: Provides for an immediate effective date. JUSTIFICATION : Family Court in New York State should have jurisdiction over qualified domestic relation orders in child support proceedings to insure that the best interests of the child is met. MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the family court act, in relation to granting jurisdic- tion over qualified domestic relation orders in child support proceedings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 411 of the family court act, as amended by chapter 398 of the laws of 1997, is amended to read as follows: S 411. Jurisdiction. The family court has exclusive original jurisdic- tion over proceedings for support or maintenance under this article and in proceedings under article five-B of this act, known as the uniform interstate family support act. On its own motion, the court may at any time in the proceedings also direct the filing of a neglect petition in accord with article ten of this act. THE FAMILY COURT SHALL FURTHER HAVE JURISDICTION OVER QUALIFIED DOMESTIC RELATIONS ORDERS IN CHILD SUPPORT PROCEEDINGS. S 2. This act shall take effect immediately.
