BILL NUMBER: S4180 TITLE OF BILL : An act to amend the labor law and the tax law, in relation to establishing the family and medical leave independent savings account act PURPOSE OR GENERAL IDEA OF BILL : Authorizes the Commissioner of Labor to establish a family and medical leave independent savings account plan for employees to draw benefits from during periods of leave pursuant the federal Family and Medical Leave Act, 29 D.S.C. §2601. SUMMARY OF SPECIFIC PROVISIONS : Section 1 of the bill amends the Labor Law enacting the following provisions: * Authorizes the Commissioner of Labor to establish a family and medical leave independent savings account plan for all employees. * Requires all employers, at the request of an employee, to defer part of the compensation of the employee by payroll deduction, and transfer

JOHNSON, LARKIN, MORAHAN, RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law and the tax law, in relation to establish- ing the family and medical leave independent savings account act THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The labor law is amended by adding a new article 32 to read as follows: ARTICLE 32 FAMILY AND MEDICAL LEAVE INDEPENDENT SAVINGS ACCOUNT ACT SECTION 1000. SHORT TITLE. 1001. DEFINITIONS. 1002. ESTABLISHMENT OF PLAN. 1003. DISTRIBUTION REQUIREMENTS. S 1000. SHORT TITLE. THIS ARTICLE SHALL BE KNOWN AND MAY BE CITED AS THE "FAMILY MEDICAL LEAVE INDEPENDENT SAVINGS ACCOUNT ACT". S 1001. DEFINITIONS. AS USED IN THIS ARTICLE: 1. "COMMISSIONER" MEANS THE COMMISSIONER OF LABOR. 2. "EMPLOYEE" MEANS ANY PERSON EMPLOYED FOR HIRE BY AN EMPLOYER IN ANY EMPLOYMENT. 3. "EMPLOYER" MEANS ANY PERSON, CORPORATION, LIMITED LIABILITY COMPA- NY, OR ASSOCIATION EMPLOYING ANY INDIVIDUAL IN ANY OCCUPATION, INDUSTRY, TRADE, BUSINESS OR SERVICE. THE TERM "EMPLOYER" SHALL ALSO MEAN: A COUN- TY, CITY, TOWN, VILLAGE OR ANY OTHER POLITICAL SUBDIVISION AS DEFINED IN SECTION ONE HUNDRED THIRTY-ONE OF THE RETIREMENT AND SOCIAL SECURITY LAW OR CIVIL DIVISION OF THE STATE; A SCHOOL DISTRICT OR ANY GOVERNMENTAL ENTITY OPERATING A PUBLIC SCHOOL, COLLEGE OR UNIVERSITY; A PUBLIC IMPROVEMENT OR SPECIAL DISTRICT; A PUBLIC AUTHORITY, COMMISSION OR PUBLIC BENEFIT CORPORATION; ANY OTHER PUBLIC CORPORATION, AGENCY OR INSTRUMENTALITY OR UNIT OF GOVERNMENT WHICH EXERCISES GOVERNMENTAL EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
