BILL NUMBER: S4227 TITLE OF BILL : An act to amend the penal law, in relation to penalties for graffiti and related misdemeanors PURPOSE : To additionally penalize persons guilty of misdemeanors related to reckless endangerment of property (Vandalism), making graffiti and possession of graffiti instruments by revocation, or ineligibility to obtain a driver's license until age 21. SUMMARY OF PROVISIONS : Section 1. Reckless endangerment of property by a person A) 15 years and younger is a class b misdemeanor additionally punishable by ineligibility to obtain a driver's license until the age of 21. B) Between the ages of 16 and 21 is a class b misdemeanor additionally punishable by suspension of his or her driver's license until age 21 or ineligibility to obtain a driver's license until the age of 21. C) By a person age 21 and over remains a class b misdemeanor.

The second undesignated paragraph of section 145.25 of the penal law is amended to read as follows: Reckless endangerment of property BY A PERSON FIFTEEN YEARS OF AGE OR YOUNGER is a class B misdemeanor ADDITIONALLY PUNISHABLE BY INELIGIBIL- ITY FOR A DRIVER'S LICENSE UNTIL THE AGE OF TWENTY-ONE; RECKLESS ENDAN- GERMENT OF PROPERTY BY A PERSON BETWEEN THE AGES OF SIXTEEN AND TWENTY IS A CLASS B MISDEMEANOR ADDITIONALLY PUNISHABLE BY SUSPENSION OF HIS OR HER DRIVER'S LICENSE UNTIL THE AGE OF TWENTY-ONE OR INELIGIBILITY FOR A DRIVER'S LICENSE UNTIL THE AGE OF TWENTY-ONE; RECKLESS ENDANGERMENT OF PROPERTY BY A PERSON AGE TWENTY-ONE YEARS OF AGE OR OLDER IS A CLASS B MISDEMEANOR.
