BILL NUMBER: S4360 TITLE OF BILL : An act to amend the general business law, in relation to requiring the labeling of apples and apple products offered for sale indicating the use of daminozide JUSTIFICATION : Consumers in New York State should be made aware of the possible threat of cancer posed by the use of daminozide. The concern over the plant growth regulator which improves the color, firmness and shelf life of apples has prompted various environmental advocacy groups to further investigate the health risks involved with the use of daminozide. The Natural Resources Defense Council (NRDC) released a report on the levels of pesticide residues found in various fruits and vegetables. The report concluded that preschoolers, who consume seven times as many apples and eighteen times as much apple juice as the average adult relative to their body weight, are being exposed to hazardous levels of pesticide residues. The report further stated that 50% of a person's lifetime risk of developing cancer from exposure to pesticide residues on fruit is incurred during the first six years of life. UDMH, a by-product of daminozide, is the greatest source of this cancer risk according to the NRDC. The Consumer's Union performed a study on various brands of apple

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to requiring the labeling of apples and apple products offered for sale indicating the use of daminozide THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 397-b to read as follows: S 397-B. LABELING OF APPLES AND APPLE PRODUCTS. 1. NO PERSON SHALL SELL OR OFFER FOR SALE ANY APPLES OR APPLE PRODUCTS UNLESS THERE IS A SIGN POSTED ABOVE OR AFFIXED TO THE DISPLAY STAND STATING WHETHER SUCH APPLES OFFERED FOR SALE OR THE APPLES USED IN THE PRODUCTION OF SUCH APPLE PRODUCTS HAVE BEEN TREATED WITH DAMINOZIDE. SUCH SIGN SHALL BE CONSPICUOUSLY POSTED WITH LETTERING NO SMALLER THAN FOUR INCHES IN HEIGHT. 2. ANY PERSON WHO SUPPLIES APPLES OR APPLE PRODUCTS TO ANOTHER PERSON FOR SALE AT RETAIL SHALL INCLUDE IN EACH DELIVERY, A CERTIFICATION ON A FORM PROVIDED BY THE DEPARTMENT OF AGRICULTURE AND MARKETS WHETHER SUCH APPLES WERE TREATED WITH DAMINOZIDE. 3. ANY PERSON WHO SELLS OR OFFERS FOR SALE ANY APPLES OR APPLE PRODUCTS IN VIOLATION OF THE PROVISIONS OF THIS SECTION SHALL BE GUILTY OF A MISDEMEANOR. S 2.
