BILL NUMBER: S4385 TITLE OF BILL : An act to amend the retirement and social security law, in relation to military service credit for Gulf war veterans SUMMARY OF PROVISIONS : Permits members who retired prior to December 21, 1998 to apply for credit for military service within one year of the effective date of this act. EXISTING LAW : Under current law, only individuals who retired after the above date had the opportunity to apply for credit for their prior military service. The legislation improves a 1998 law that allowed veterans to get retirement credit for the years they served in the military during wartime, but only if they had not already retired. Many feel that not extending this options to retired veterans is unfair, especially since a high number of World War II and Korean War veterans had already retired by the time the buy-back was offered. Another concern is that ailments arising out of previous wartime service may have prompted some of these men and women to retire earlier than their non-veteran peers, and thereby lose the opportunity to get the retirement credit
