AN ACT to amend the penal law, in relation to establishing the crime  of
  sexual abuse of authority

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The penal law is amended by adding a new section 130.97  to
read as follows:
S 130.97 SEXUAL ABUSE OF AUTHORITY.
  A PERSON IS GUILTY OF SEXUAL ABUSE OF AUTHORITY WHEN HE OR SHE ENGAGES
IN  SEXUAL  CONDUCT  WITH ANOTHER WHO IS  NOT THE SPOUSE OF THE OFFENDER
WHEN THE OFFENDER IS A TEACHER, ADMINISTRATOR, COACH, OR OTHER PERSON IN
AUTHORITY EMPLOYED BY OR SERVING IN AN ELEMENTARY OR SECONDARY SCHOOL OF
THE STATE, OR COLLEGE OR UNIVERSITY OF THE STATE, AND THE  OTHER  PERSON
IS  ENROLLED  IN  OR ATTENDS SUCH SCHOOL, COLLEGE OR UNIVERSITY, AND THE
OFFENDER IS NOT ENROLLED IN AND DOES NOT ATTEND THAT SCHOOL.
  SEXUAL ABUSE OF AUTHORITY IS A CLASS A MISDEMEANOR.
  S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
