BILL NUMBER: S4541 TITLE OF BILL : An act to amend the executive law, in relation to establishing criteria for the location of state facilities in cities with a population of one million or more PURPOSE OR GENERAL IDEA OF BILL : This bill provides that the community notification and empowerment act which provides criteria for siting state facilities in New York City SUMMARY OF SPECIFIC PROVISIONS : JUSTIFICATION : The purpose of this bill is to set forth the process for siting state facilities in cities with a population of one million or more. This would ensure the compatibility of the proposed facility with existing facilities and programs with the area of the proposed site. SQUADRON -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to establishing criteria for the location of state facilities in cities with a population of one million or more THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new article 41-A to read as follows: ARTICLE 41-A LOCATION OF STATE FACILITIES IN CITIES WITH A POPULATION OF ONE MILLION OR MORE SECTION 908-A. SHORT TITLE. 908-B. DEFINITIONS. 908-C. PROCESS FOR SITING STATE FACILITIES IN A CITY WITH A POPULATION OF ONE MILLION OR MORE. 908-D. CRITERIA FOR SITING STATE FACILITIES IN A CITY WITH A POPULATION OF ONE MILLION OR MORE. 908-E. STATE RESPONSE. S 908-A. SHORT TITLE. THIS ARTICLE SHALL BE KNOWN AND MAY BE CITED AS THE "COMMUNITY NOTIFICATION AND EMPOWERMENT ACT". S 908-B. DEFINITIONS. WHEN USED IN THIS ARTICLE THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: 1. "STATE FACILITY" SHALL MEAN ANY FACILITY, EXCEPT FACILITIES SUBJECT TO REAL PROPERTY TAX EXEMPTION OR TAX ABATEMENTS UNDER SECTION FOUR HUNDRED EIGHTY-NINE OF THE REAL PROPERTY TAX LAW, THAT MEETS THE FOLLOW- ING CRITERIA: (A) THE FACILITY PROVIDES STATE SERVICES; AND (B) THE FACILITY CONSISTS OF PROPERTY CONTAINING TWENTY-FIVE THOUSAND SQUARE FEET OR MORE; AND (C) (1) THE PROPERTY IS OWNED OR LEASED BY THE STATE; OR EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
