BILL NUMBER: S4553 TITLE OF BILL : An act to amend the criminal procedure law, in relation to designating directors of public safety of the town of Brookhaven as peace officers PURPOSE : To designate directors of public safety of the town of Brookhaven as peace officers. SUMMARY OF PROVISIONS : Amends Section 2.10 of the Criminal Procedure Law to add new subdivision which would grant Peace Officer status to the town of Brookhaven directors of public safety. JUSTIFICATION : The Town of Brookhaven has requested that the Town's Directors of Public Safety be granted peace officer status. These directors have been charged, in addition to other duties, the task of enforcing the residency requirements imposed upon registered sex offenders. The bill does not authorize the directors to carry firearms. LEGISLATIVE HISTORY : New bill. FISCAL IMPLICATIONS : None to the state. EFFECTIVE DATE : This act shall take effect immediately.

ENGLEBRIGHT -- read once and referred to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to designating directors of public safety of the town of Brookhaven as peace officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 83 to read as follows: 83. DIRECTORS OF PUBLIC SAFETY OF THE TOWN OF BROOKHAVEN; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
