                                 BILL NUMBER:  S4574

 TITLE OF BILL :

An act to amend chapter 704 of the laws of 1991 amending the arts and
cultural affairs law and chapter 912 of the laws of 1920 relating to
the regulation of boxing and wrestling relating to tickets to places
of entertainment, in relation to extending the provisions thereof


 PURPOSE :

The purpose of this legislation is to extend the existing ticket
resale statute for an additional three years until June 1, 2012.

 SUMMARY OF PROVISIONS :

Section one of this bill would amend section 4 of chapter 704 of the
laws of 1991, amending the arts and cultural affairs law and chapter
912 of the laws of 1920 relating to the regulation of boxing and
wrestling relating tickets to places of entertainment, as amended by
chapter 374 of the laws of 2007 by extending the sunset provision of
Article 25 of the Arts and Cultural Affairs Law to June 1, 2012.

 JUSTIFICATION :

In 1999 the New York State Attorney General issued a report that
stated that New York should clean up the way it regulates ticket
sales. After decades of imposing caps on ticket resales which lead to
an unregulated black market, State law was changed in 2007 to
implement a free market system for the resale of tickets. This free
market law and the repeal of the ticket scalping statute opened up the
process which gives the public a better and fairer shot to buy good
seats at concerts, sporting, and theater events at reasonable prices.
The free market law is set expire June 1, 2009. This measure would
extend New York's free market law for an additional three years until
June 1, 2012.

Past caps on the secondary resale of tickets did not work and many
falsely believed the price cap restriction protected consumers from
exorbitant prices yet primary market tickets can be priced and sold at
whatever price the market will bear. The cap restriction did not
account for the economic principle of supply and demand driving
prices. The past cap hurt consumers by increasing fraud and prices.
Before New York's free market system, consumers were forced into back
alleys to purchase tickets in a gray market that had a higher
incidence of fraud.

Since the free market took place in New York State in 2007, there is
no indication that the current system in place is not working as it
was intended. This bill would extend the existing law for three years
to allow for further analysis and to ensure that the current statute
gives consumers the best value and opportunity to purchase tickets to
their favorite venues.

AN ACT to amend chapter 704 of the laws of 1991 amending  the  arts  and
  cultural  affairs  law and chapter 912 of the laws of 1920 relating to
  the regulation of boxing and wrestling relating to tickets  to  places
  of entertainment, in relation to extending the provisions thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 4 of chapter 704 of the laws of 1991, amending  the
arts and cultural affairs law and chapter 912 of the laws of 1920 relat-
ing  to  the  regulation  of boxing and wrestling relating to tickets to
places of entertainment, as amended by chapter 374 of the laws of  2007,
is amended to read as follows:
  S  4.  This  act  shall take effect on the sixtieth day after it shall
have become a law, provided, chapter 61 of the laws of  2007  shall  not
take  effect  with  respect  to the issuance of licenses or certificates
under this article by the secretary of  state  or  department  of  state
until  January  1, 2008 and regulation under this article by the commis-
sioners of licenses of the political subdivisions  of  the  state  shall
continue  through  December 31, 2007, and shall remain in full force and
effect only until and including June 1, [2009] 2012 when such act  shall
be  repealed  and  when, notwithstanding any other provision of law, the
provisions of article 25 of title G of the  arts  and  cultural  affairs
law, repealed by such act, shall be reinstituted. Provided, however, the
printing  on  tickets  required  pursuant to sections 25.07 and 25.08 of
article 25 of the arts and cultural affairs law, as added by  this  act,
shall not apply to tickets printed prior to enactment of such article so
long  as  notice  of the higher maximum premium price and prohibition of
sales within one thousand five hundred feet from the physical  structure
of   the  place  of  entertainment,  where  applicable,  is  prominently
displayed at the point of sale and at such place of entertainment.
  S 2. This act shall take effect immediately.
