BILL NUMBER: S4638 TITLE OF BILL : An act to amend the civil service law, in relation to special rights for children and siblings of members of the uniformed force of the department of sanitation PURPOSE : Provides civil service examination credits to children and siblings of uniformed sanitation workers killed in the line of duty. SUMMARY OF PROVISIONS : This legislation would provide an additional ten points in competitive examinations to (1) children of the uniformed force of the department of sanitation killed in the line of duty and (2) siblings of members of the uniformed force of the department of sanitation killed in the line of duty in connection with the September 11th attacks. Specifically, the bill adds members of the uniformed force of the department of sanitation to Section 85-a of the Civil Service Law, providing additional credits to children of members of the uniformed force of the department of sanitation killed in the line of duty. Currently Section 85-a provides this credit to children of firefighters and police officers. In Addition, Section 85-b of the Civil Service Law would be amended to include members of the uniformed force of the department of sanitation. In this section, "killed in the

ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to special rights for children and siblings of members of the uniformed force of the depart- ment of sanitation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The section heading and subdivision 1 of section 85-a of the civil service law, as added by chapter 495 of the laws of 2002, paragraph (a) of subdivision 1 as amended by chapter 75 of the laws of 2008, are amended to read as follows: Additional credits allowed children of firefighters [and], police officers AND MEMBERS OF THE UNIFORMED FORCE OF THE DEPARTMENT OF SANITA- TION killed in the line of duty. 1. Additional credit authorized. Addi- tional credits shall be allowed children of firefighters [and], police officers AND MEMBERS OF THE UNIFORMED FORCE OF THE DEPARTMENT OF SANITA- TION killed in the line of duty, as "child" in this section in compet- itive examinations for original appointment. (a) On all eligible lists resulting from competitive examinations, the names of eligible persons shall be entered in the order of their respective final earned ratings on examinations, with the name of the eligible person with the highest final earned ratings at the head of such list, provided, however, that for the purpose of determining final earned ratings, children of fire- fighters [and], police officers AND MEMBERS OF THE UNIFORMED FORCE OF THE DEPARTMENT OF SANITATION killed in the line of duty shall be enti- tled to receive an additional ten points in a competitive examination for original appointment in the same municipality in which his or her parent has served. For the purposes of this paragraph, a police officer or firefighter shall be deemed to have "served" in a municipality if he or she was employed by, or worked primarily in, that municipality.
