BILL NUMBER: S4663 TITLE OF BILL : An act to amend the tax law, in relation to the imposition of taxes on the use of motor vehicles in the county of Suffolk PURPOSE/SUMMARY OF PROVISIONS : The bill authorizes Suffolk County to adopt a local law to construct a fee schedule similar to both Nassau and Westchester County. The new fee schedule would call for a $10 per year fee increase for passenger vehicles under 3500 lbs., a $5 per year fee increase for passenger vehicles over 3500 lbs., and a $30 per year fee increase for commercial vehicles (excluding farm vehicles). JUSTIFICATION : Both Nassau and Westchester County have fee schedules that generate more revenue than those provided to Suffolk County under current legislation. By allowing Suffolk County the option of raising its fees, the additional revenues generated could be used to offset increases in energy costs due to the rise in petroleum products (i.e. gasoline and asphalt). In addition, this new fee schedule would provide Suffolk County a source of recurring revenue for its general fund. FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS : No fiscal implications for the state. Suffolk County anticipates that it would amass an additional $4.1 million in revenues.

FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the tax law, in relation to the imposition of taxes on the use of motor vehicles in the county of Suffolk THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1202 of the tax law is amended by adding a new subdivision (g) to read as follows: (G) THE COUNTY OF SUFFOLK, IN IMPOSING TAXES OF THE TYPE AUTHORIZED UNDER SUBDIVISION (E) OF SECTION TWELVE HUNDRED ONE OF THIS PART, MAY IMPOSE TAXES ON THE USE OF PASSENGER MOTOR VEHICLES OF A TYPE COMMONLY USED FOR NON-COMMERCIAL PURPOSES OWNED BY RESIDENTS OF THE COUNTY AT A RATE PER ANNUM FOR EACH SUCH VEHICLE OF NOT IN EXCESS OF FIFTEEN DOLLARS IF SUCH VEHICLE WEIGHS THIRTY-FIVE HUNDRED POUNDS OR LESS AND NOT IN EXCESS OF THIRTY DOLLARS PER ANNUM IF SUCH VEHICLE WEIGHS MORE THAN THIRTY-FIVE HUNDRED POUNDS; AND TAXES ON THE USE OF TRUCKS, BUSES AND OTHER SUCH COMMERCIAL MOTOR VEHICLES USED PRINCIPALLY IN CONNECTION WITH A BUSINESS CARRIED ON WITHIN THE COUNTY, EXCEPT WHEN OWNED AND USED IN CONNECTION WITH THE OPERATION OF A FARM BY THE OWNER OR TENANT THEREOF, AT A RATE PER ANNUM FOR EACH SUCH VEHICLE OF NOT IN EXCESS OF THIRTY DOLLARS.
