BILL NUMBER: S4690 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to a limit on intact animals and the definition of pet dealers PURPOSE OR GENERAL IDEA OF BILL : To help curtail the abusive treatment that dogs and cats receive from pet dealers and breeders SUMMARY OF SPECIFIC PROVISIONS : Section one amends the agriculture and markets law by adding a new section 380 which provides that the number of dogs or cats with intact sexual organs - not spayed or neutered - that a person or business may own, possess, control or otherwise have charge or custody of shall be limited to fifty. A violation of this section is a class A misdemeanor. Section two amends section 373 of the agriculture and markets law by adding a new subdivision 2-a which provides that an agent or officer may lawfully take possession of any animals kept in violation of new section 380 of the agriculture and markets law, provided that a proper warrant authorizing entry and search is issued by any magistrate authorized to issue warrants in criminal cases and such warrant is based on a complaint, made under oath or affirmation stating grounds that are just and reasonable. KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to a limit on intact animals and the definition of pet dealers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The agriculture and markets law is amended by adding a new section 380 to read as follows: S 380. LIMIT ON INTACT ANIMALS. NO PERSON OR BUSINESS BUYING, SELLING, OR OFFERING FOR SALE DOGS OR CATS TO THE PUBLIC OR AT WHOLESALE SHALL OWN, POSSESS, CONTROL OR OTHERWISE HAVE CHARGE OR CUSTODY OF MORE THAN FIFTY DOGS AND CATS WITH INTACT SEXUAL ORGANS. A VIOLATION OF THIS SECTION IS A CLASS A MISDEMEANOR. NOTHING IN THIS SECTION SHALL BE CONSTRUED TO AFFECT ANY PROTECTIONS AFFORDED TO DOGS, CATS, OR OTHER ANIMALS UNDER ANY OTHER PROVISIONS OF THIS ARTICLE. S 2. Section 373 of the agriculture and markets law is amended by adding a new subdivision 2-a to read as follows: 2-A. ANY SUCH AGENT OR OFFICER MAY ALSO LAWFULLY TAKE POSSESSION OF ANY ANIMALS KEPT IN VIOLATION OF SECTION THREE HUNDRED EIGHTY OF THIS ARTICLE, PROVIDED THAT A COMPLAINT STATING JUST AND REASONABLE GROUNDS IS MADE UNDER OATH OR AFFIRMATION TO ANY MAGISTRATE AUTHORIZED TO ISSUE WARRANTS IN CRIMINAL CASES, AND THAT SUCH WARRANT AUTHORIZING ENTRY AND SEARCH IS ISSUED AND DELIVERED BY SUCH MAGISTRATE; IF JUST AND REASON- ABLE CAUSE IS SHOWN, THE MAGISTRATE SHALL IMMEDIATELY ISSUE SUCH WARRANT. S 3. Subdivision 4 of section 400 of the agriculture and markets law, as amended by chapter 687 of the laws of 2006, is amended to read as follows: 4. "Pet Dealer" means any person who engages in the sale or offering for sale of more than nine animals per year for profit AT WHOLESALE OR to the public.
