BILL NUMBER: S4704 TITLE OF BILL : An act to amend the education law, in relation to funding of library systems PURPOSE : This bill seeks to permit voters in certain localities to initiate increases in local funding for public library systems. SUMMARY OF SPECIFIC PROVISIONS : This bill would amend the Education Law, to permit the people of a municipality to place on a local ballot a proposition for public library system purposes. Such ballot initiative would be accomplished by the circulation and filing of a petition containing signatures equal to ten percent of the people who voted in the last gubernatorial election in such municipality Such petition must indicate the amount of the library funding increase, and such proposition must be endorsed by resolution of the library system board of trustees.

LEIBELL -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to funding of library systems THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 1 of paragraph b of subdivision 1 of section 259 of the education law, as amended by chapter 184 of the laws of 2007, is amended to read as follows: (1) Except as provided in subparagraph two of this paragraph, whenever qualified voters of a municipality, in a number equal to at least ten per centum of the total number of votes cast in such municipality for governor at the last gubernatorial election, shall so petition and the library board of trustees shall endorse, the question of establishing or increasing the amount of funding of the annual contribution for the operating budget of a PUBLIC LIBRARY SYSTEM OR registered public or free association library by such municipality to a sum specified in said petition, shall be voted on at the next general election of such munici- pality, provided that due public notice of the proposed action shall have been given. An increase in library funding provided pursuant to this paragraph shall not apply to a municipal budget adopted prior to the date of such election. S 2. This act shall take effect immediately.
