BILL NUMBER: S4705 TITLE OF BILL : An act to amend the insurance law, in relation to notification of the importance and usefulness of uninsured and underinsured motorist coverage PURPOSE OR GENERAL IDEA OF BILL : This bill seeks to inform automobile owners of the value and importance of uninsured and underinsured motorist coverage. SUMMARY OF SPECIFIC PROVISIONS : This bill would amend the insurance law to provide, that no policy providing automobile physical damage insurance for private passenger automobiles registered in this state, shall be issued, delivered or renewed, without an informational disclaimer being provided to the insured, in writing, prior to the time of such issuance, delivery or renewal, concerning the importance and usefulness of uninsured and underinsured motorist coverage, and that the superintendent shall be responsible for the drafting of the informational disclaimer. LEIBELL -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to notification of the importance and usefulness of uninsured and underinsured motorist coverage THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The insurance law is amended by adding a new section 3411-a to read as follows: S 3411-A. NOTIFICATION OF UNINSURED AND UNDERINSURED MOTORIST COVER- AGE. (A) NO POLICY PROVIDING AUTOMOBILE PHYSICAL DAMAGE INSURANCE FOR PRIVATE PASSENGER AUTOMOBILES REGISTERED IN THIS STATE SHALL BE ISSUED, DELIVERED OR RENEWED WITHOUT AN INFORMATIONAL DISCLAIMER BEING PROVIDED TO THE INSURED IN WRITING, PRIOR TO THE TIME OF SUCH ISSUANCE, DELIVERY OR RENEWAL, CONCERNING THE IMPORTANCE AND USEFULNESS OF UNINSURED AND UNDERINSURED MOTORIST COVERAGE. (B) THE SUPERINTENDENT SHALL BE RESPONSIBLE FOR THE DRAFTING OF THE INFORMATIONAL DISCLAIMER DESCRIBED IN SUBSECTION (A) OF THIS SECTION. S 2. This act shall take effect immediately and shall apply to poli- cies issued, delivered, or renewed on and after such effective date.
