BILL NUMBER: S4713 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to distinctive license plates for childhood cancer awareness; and to amend the state finance law, in relation to creating the childhood cancer awareness fund PURPOSE OR GENERAL IDEA OF BILL: : This bill would create a distinctive Childhood Cancer Awareness license plate for motor vehicles in New York State, and to establish a Childhood Cancer Awareness fund to support childhood cancer prevention and cure research initiatives. SUMMARY OF SPECIFIC PROVISIONS: : This bill would amend the Vehicle and Traffic Law to provide that any person residing within New York State may request a distinctive Childhood Cancer Awareness license plate in the same manner as other license plates within the state, except that an additional annual service charge of twenty-five ($25) dollars shall be charged for such license plate. Additional moneys received pursuant to this program would be deposited in the Childhood Cancer Awareness Fund created under the State Finance Law, provided, however, that one (1) year after the effective date of this section funds in the amount of six thousand ($6,000) dollars, or so much thereof as may be available, would be allocated to the Department to offset costs associated with the production of such

LEIBELL -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to distinctive license plates for childhood cancer awareness; and to amend the state finance law, in relation to creating the childhood cancer awareness fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 404-x to read as follows: S 404-X. DISTINCTIVE CHILDHOOD CANCER AWARENESS LICENSE PLATES. 1. ANY PERSON RESIDING IN THIS STATE SHALL, UPON REQUEST, BE ISSUED A DISTINCTIVE CHILDHOOD CANCER AWARENESS LICENSE PLATE IN SUPPORT OF CHILDHOOD CANCER RESEARCH BEARING THE PHRASE "CHILDHOOD CANCER AWARE- NESS". APPLICATION FOR SAID LICENSE PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 2. A DISTINCTIVE CHILDHOOD CANCER AWARENESS LICENSE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON THE PAYMENT OF THE REGULAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE, PROVIDED, HOWEV- ER, THAT AN ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-FIVE DOLLARS SHALL BE CHARGED FOR SUCH PLATE. MONEYS RECEIVED PURSUANT TO THIS SUBDI- VISION SHALL BE DEPOSITED IN THE CHILDHOOD CANCER AWARENESS FUND CREATED UNDER SECTION EIGHTY-NINE-H OF THE STATE FINANCE LAW. PROVIDED, HOWEVER THAT ONE YEAR AFTER THE EFFECTIVE DATE OF THIS SECTION FUNDS IN THE AMOUNT OF SIX THOUSAND DOLLARS, OR SO MUCH THEREOF AS MAY BE AVAILABLE, SHALL BE ALLOCATED TO THE DEPARTMENT TO OFFSET COSTS ASSOCIATED WITH THE PRODUCTION OF SUCH LICENSE PLATES. S 2. The state finance law is amended by adding a new section 89-h to read as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
