BILL NUMBER: S4732 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to exempting motor vehicles owned by volunteer firefighters and used in the performance of their duties from the payment of motor vehicle registration fees and taxes PURPOSE : This bill would exempt volunteer firefighters from the payment of registration fees and use tax on the motor vehicles they own and use to perform their duties. SUMMARY OF SPECIFIC PROVISIONS : This bill would amend the Vehicle and Traffic law to exempt volunteer firefighters from the payment of registration fees and use tax on the motor vehicles they own and use to perform their duties. This bill would further amend the vehicle and traffic law, to include that distinctive plates will be given to volunteer firefighters at no expense.

LEIBELL -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to exempting motor vehicles owned by volunteer firefighters and used in the performance of their duties from the payment of motor vehicle regis- tration fees and taxes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 401 of the vehicle and traffic law is amended by adding a new paragraph h to read as follows: H. MOTOR VEHICLES OWNED BY VOLUNTEER FIREFIGHTERS WHICH ARE USED IN THE PERFORMANCE OF THEIR DUTIES AS VOLUNTEER FIREFIGHTERS SHALL BE EXEMPT FROM ALL VEHICLE REGISTRATION FEES AND FROM ANY VEHICLE USE OR OTHER TAX BASED UPON THE WEIGHT OR VALUE OF THE VEHICLE, NOTWITHSTANDING ANY PROVISION OF THIS CHAPTER OR OTHER LAW AUTHORIZING THE IMPOSITION OF SUCH FEES OR TAX. S 2. Subdivision 3 of section 404-b of the vehicle and traffic law, as amended by chapter 277 of the laws of 1991, is amended to read as follows: 3. A distinctive plate issued pursuant to this section shall be issued in the same manner as other number plates upon payment of the regular registration fee prescribed by section four hundred one of this chapter and an initial one time service charge of fifteen dollars, EXCEPT THAT NO REGISTRATION FEE OR INITIAL ONE TIME SERVICE CHARGE SHALL BE IMPOSED WITH RESPECT TO ANY VEHICLE USED IN THE PERFORMANCE OF FIREFIGHTER DUTIES BY A VOLUNTEER FIREFIGHTER. S 3. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law and shall apply to certificates of registration of motor vehicles owned by volunteer fire- fighters which are issued or renewed on or after its effective date.
