BILL NUMBER: S4799 TITLE OF BILL : An act to amend chapter 154 of the laws of 1921, relating to the Port Authority of New York and New Jersey, in relation to paid time off for Port Authority police officers who become ill or injured in the performance of their duties PURPOSE : To protect member of the Port authority Police Department who become injured or ill in the line of duty. SUMMARY OF PROVISIONS : Amends the Unconsolidated Laws pertaining to the Port Authority of New York by adding a new section XXIII to providing benefits to police officers who become ill or are injured in the performance of their duties. EXISTING LAW : Under current law, the benefits of full payment of regular salary, fringe benefits and the cost of all medical treatment and hospital care during the period of a disability of a police officers, sheriffs, deputy sheriffs, correction officers, fire fighters and other defined law enforcement personnel who become injured or ill in the performance of their duties. (See GML §207-A and §207-C.) Port Authority Police Officers have a contractual guarantee of two years paid time or two and one-half years, if applying for disability retirement. SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend chapter 154 of the laws of 1921, relating to the Port Authority of New York and New Jersey, in relation to paid time off for Port Authority police officers who become ill or injured in the performance of their duties THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Chapter 154 of the laws of 1921, relating to the Port Authority of New York and New Jersey, is amended by adding a new article 23 to read as follows: ARTICLE XXIII 1. ANY MEMBER OF THE POLICE DEPARTMENT OF THE PORT AUTHORITY OF NEW YORK AND NEW JERSEY WHO IS INJURED IN THE PERFORMANCE OF HIS OR HER DUTIES OR WHO IS TAKEN SICK AS A RESULT OF THE PERFORMANCE OF HIS OR HER DUTIES SO AS TO NECESSITATE MEDICAL OR OTHER LAWFUL REMEDIAL TREATMENT SHALL BE PAID BY THE PORT AUTHORITY THE FULL AMOUNT OF HIS OR HER REGU- LAR SALARY OR WAGES UNTIL HIS OR HER DISABILITY ARISING THEREFROM HAS CEASED, AND, IN ADDITION THE PORT AUTHORITY SHALL BE LIABLE FOR ALL MEDICAL TREATMENT AND HOSPITAL CARE NECESSITATED BY REASON OF SUCH INJU- RY OR ILLNESS. PROVIDED, HOWEVER, AND NOTWITHSTANDING THE FOREGOING PROVISIONS OF THIS ARTICLE, THE PORT AUTHORITY POLICE HEALTH AUTHORITIES OR ANY PHYSICIAN APPOINTED FOR THE PURPOSE BY THE POLICE DEPARTMENT, AFTER A DETERMINATION HAS FIRST BEEN MADE THAT SUCH INJURY OR SICKNESS WAS INCURRED DURING, OR RESULTED FROM SUCH PERFORMANCE OF DUTY, MAY ATTEND ANY SUCH INJURED OR SICK MEMBER, FROM TIME TO TIME, FOR THE PURPOSE OF PROVIDING MEDICAL, SURGICAL OR OTHER TREATMENT, OR FOR MAKING INSPECTIONS AND THE POLICE DEPARTMENT SHALL NOT BE LIABLE FOR SALARY OR WAGES PAYABLE TO SUCH MEMBER, OR FOR THE COST OF MEDICAL TREATMENT OR HOSPITAL CARE FURNISHED AFTER SUCH DATE AS SUCH HEALTH AUTHORITIES OR EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
