BILL NUMBER: S4803 TITLE OF BILL : An act to amend the public health law, in relation to reimbursement rates for inpatient hospital services at Westchester medical center PURPOSE OR GENERAL IDEA OF BILL : To provide revenue to Westchester County Health Care Corporation through the adjustment of its Medicaid rate. SUMMARY OF SPECIFIC PROVISIONS : Section 1 of the bill provides technical changes to the public health law regarding the computation of reimbursement rates for Westchester Medical Center. Section 2 is the effective date. JUSTIFICATION : The Westchester County Health Care Corporation was created under the public authorities law, and in January of 1998, assumed responsibility for the operation of Westchester Medical Center (WMC), a general hospital licensed under Article 28 of the public health law, which previously had been operated by Westchester County. WMC operates 635 licensed inpatient beds, and was established to serve as the regional referral center providing tertiary services to the seven-county Hudson Valley region. STEWART-COUSINS, OPPENHEIMER, KLEIN, HASSELL-THOMP- SON -- read twice and ordered printed, and when printed to be commit- ted to the Committee on Health AN ACT to amend the public health law, in relation to reimbursement rates for inpatient hospital services at Westchester medical center THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 2807-c of the public health law is amended by adding a new paragraph (b-1) to read as follows: (B-1) IN ORDER TO ADEQUATELY REIMBURSE WESTCHESTER MEDICAL CENTER FOR THE SAFETY-NET SERVICES IT PROVIDES TO THE RESIDENTS OF THE COUNTY OF WESTCHESTER, AND TO REFLECT ITS STATUS AS A FREE-STANDING HOSPITAL, FOR DISCHARGES ON OR AFTER JANUARY FIRST, TWO THOUSAND NINE, THE REIMBURSA- BLE INPATIENT OPERATING COST PER DISCHARGE FOR THE WESTCHESTER MEDICAL CENTER SHALL BE COMPUTED BASED ON ONE HUNDRED PERCENT OF THE GROUP AVER- AGE OF THE MAJOR PUBLIC HOSPITAL GROUP, IN ACCORDANCE WITH 10 NYCRR 86-1.72(A), COMPUTED USING THE COST DATA RELATED TO ALL MEMBERS OF THE MAJOR PUBLIC HOSPITAL GROUP WITHOUT THE INCLUSION OF WESTCHESTER MEDICAL CENTER OR ITS PREDECESSORS, AND WITHOUT CHANGING THE GROUP AVERAGE OF THE ACADEMIC MEDICAL CENTER GROUP.
