AN  ACT  to  amend  the  public health law, in relation to reimbursement
  rates for inpatient hospital services at Westchester medical center

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 5 of section 2807-c of the public health law is
amended by adding a new paragraph (b-1) to read as follows:
  (B-1)  IN ORDER TO ADEQUATELY REIMBURSE WESTCHESTER MEDICAL CENTER FOR
THE SAFETY-NET SERVICES IT PROVIDES TO THE RESIDENTS OF  THE  COUNTY  OF
WESTCHESTER,  AND TO REFLECT ITS STATUS AS A FREE-STANDING HOSPITAL, FOR
DISCHARGES ON OR AFTER JANUARY FIRST, TWO THOUSAND NINE, THE  REIMBURSA-
BLE  INPATIENT  OPERATING COST PER DISCHARGE FOR THE WESTCHESTER MEDICAL
CENTER SHALL BE COMPUTED BASED ON ONE HUNDRED PERCENT OF THE GROUP AVER-
AGE OF THE MAJOR PUBLIC HOSPITAL GROUP,  IN  ACCORDANCE  WITH  10  NYCRR
86-1.72(A),  COMPUTED  USING THE COST DATA RELATED TO ALL MEMBERS OF THE
MAJOR PUBLIC HOSPITAL GROUP WITHOUT THE INCLUSION OF WESTCHESTER MEDICAL
CENTER OR ITS PREDECESSORS, AND WITHOUT CHANGING THE  GROUP  AVERAGE  OF
THE ACADEMIC MEDICAL CENTER GROUP.
  S 2. This act shall take effect immediately.
